Dear Juan Trujillo,

I am writing to you in the matter of the contract with your company named Peter Darby. I produced for your company three hundred office desks. I has passed two month since the delivery. This order was at very short notice, but we were able to react quickly and deliver .. goods in time. We have yet not receive the payment for this contract. In the terms and conditions of our sales agreement … is clearly stated, that you have to sent ..payment within thirty days of receipt of invoice. Our company is known for their patience and good handling with customers. I have already sent you two reminders, first four weeks after overdue and another four weeks after that. Feel free to check enclosed invoice and copies of the previous reminders.

Now the acount is more than eight weeks overdue and I am asking you politely to set the things straight as fast as possible. I have constantly waited for the payment and it has affected my work and future contracts with other customers. I have to warn you that you have already been charged 3% a month in adition to payment for the late remittance as is stated in our terms and conditions. If we do not close this deal until next month, an interest will be raised to 5% a month and you will be charged extra fee in ammount of 10% of your debt. I also intend to take more steps if you keep not responding to our cause but I honestly hope that taking this deal in front of the court will not be necessary.

I believe this is a big misunderstanding and we will close this deal in short time. I thank you for your cooperation regarding this matter. I wish you well in your future and I hope we can continue doing business together, that will be smooth once again.

Yours sincerely

Martin Zajiček

The only agreement that was made between the two was at the start.. The 90 day period that was paid off by BTT for Chou. After this there was no actual contract. They did discuss about having a contract and making it go through email but in the end there came out to be no contract. As it came out to be with no legal signatures from either of the sides then there was nothing to keep.…

By studying the situation, I don't believe the 2 sides concerned ever had a deal. In the situation, the sides reached a deal just 3 days ahead of the conclusion of a 90-day time frame set in the initial negotiation deal. In the initial negotiation deal, it says that there would be no distribution agreement until it was on paper. As soon as the BTT manager posted the e-mail to Chou, he described the conditions of a distribution contract; however it doesn't make the email an agreement as neither side inked it. Just a verbal deal was reached. With no legally binding draft and the signature of both sides present, no agreement existed.…

The contract is for commercial cleaning and the winner of the contract is Sparkle and Shine Cleaning Services. A condition of the contract consists of completing up to 30% of the contract within 45 days of the contract effective date. Unfortunately, Sparkle and Shine may need to solicit additional laborers due to 45 days not being long enough. The cleaning services are needed much sooner than that. The Department of Veterans Affairs would like to change the timeframe from 45 to 21 days. It appears that the contract for Sparkle and Shine may not be capable of completing 30% of the contract requirements within such a short time frame. Due to the drastic change, Sparkle and Shine is disputing the change.…

As you know, eight months ago we entered into a contract with Citizen-Schwarz AG to create custom e-banking software. The agreed contract outlined the details of the arrangement, including on-schedule delivery and quality of the deliverables, strong communication between both parties, procedures for any changes in the system requirements, intellectual property rights, and dispute management procedures. Depending on our performance, we were projecting to gain an additional contract with C-S’s larger e-CRM order. Unfortunately, the original contract was filled with ambiguity from the start that increased the risk factor for both parties.…
