Bryant filed suit against defendant Aiken Regional Medical Centers, Inc. (ARMC), alleging that ARMC had denied her a promotion on several occasions both because of her race and in retaliation for her complaints about discrimination in ARMC's hiring policies. A jury found in her favor and awarded her backpay, compensatory damages for emotional distress, and punitive damages. The district court declined to overturn the jury's verdict. We affirm the jury's finding of liability and its award of backpay and compensatory damages for emotional distress, but we reverse the award of punitive damages.” This article represents harassment in the …show more content…
I have seen someone go through a similar situation at a pass job. “Bryant also complained, she testified, to her supervisor and to the hospital's service excellence coordinator (who was a designated point person for race discrimination complaints) that she believed she was being discriminated against in the promotion process because of her race. The service excellence coordinator told her that he would "check into it" and get back to her with a response. She never heard anything back from him.” At my prior job I was friend’s with an African American. She was a really hard worker and everyone got along with her except for one person. Our boss was very prejudice to her. She was the only African American that worked there. I am from Wisconsin were there are mainly white people in the area in which we lived in. She drove up from Milwaukee to this job. This boss would make her stay late if something needed to be done all of the time. We worked in a union shop and seniority should be used. She went and complained to upper management and they would always tell her we would get back to you. Well about a year of her going up to upper management and getting nowhere she finally

Based on Title VII of the Civil Rights Act of 1964 employers are not allowed to discriminate against a potential employee based on race, color, sex, religion, or national origin. In the Dunlap v. Tennessee Valley Authority case this title of the civil rights act was violated. An African American man named David Dunlap who gave almost the exact same answers as white candidates who got the job and who had 20 years of experience in boiler making was not chosen for any of the 10 positions available with the TVA. The issue is not only that he wasn’t hired but based on the score sheet he was highly discriminated against. When asked how many days he missed Dunlap told the employers that he never missed days unless sick or having a family emergency, two other candidates who just so happened to be white gave almost the exact same answer. On the score sheet for this question Dunlap was given a score of 3.7 while the other two potential employees were given scores of 4.2 and 5.5. Also when he was asked about how many accidents he had in the field he replied none and was given a low score but another candidate whom had at least two accidents was given a higher score than Dunlap. The issue at hand was that, his score sheet was heavily manipulated putting him in number 14 out of the 21 candidates that had applied. The top ten got hired.…

The IAD investigation determined that there was no basis for Williamson’s allegations. Williamson sued the City of Houston under Title VII of the Civil Rights Act for hostile work environment sexual harassment and for retaliation against her for reporting the harassment. In a District Court, a jury found the city liable for both sexual harassment and for retaliation. Williamson was awarded back pay and compensatory damages, as well as court costs and attorney’s fees. On appeal to the Fifth Circuit, U.S. Court of Appeals, the City of Houston challenged the judgment on the grounds that it did not have notice of the harassment until April 1992 and that her notification to her supervisor should not have constituted notice to the city. The District Court’s ruling was affirmed by the Appeals Court. 3. Main Issue: Can a supervisor’s knowledge of harassing behavior be imputed to the city to show that the city knew, or should have known, of the harassing behavior and can therefore be held liable for failing to stop the behavior? 4. Court Deciding: United States Court of Appeals, Fifth Circuit. 5. Decision: Summary judgment affirming the decision of the District…

The majority of racial discrimination cases are very difficult to analyze. The case of “promotion at uptown Bottling and Canning Company” is not the exception. The key points that I found to study in this case are the ration of management positions offered between black and white employees, the time when Grant applied for the open position and was granted to Thompson and the leadership potential excuse that Grant was given when the company denied him for the promotion.…
