Creating the contract is an extremely difficult process. A contract must have an offer and acceptance determine whether an agreement exists between two parties. An offer is a suggestion made by one person to another of his or her readiness to enter into an agreement under certain terms and conditions without further negotiations. The contract is accepted when the offer has been formally communicated to the offeror by the offeree. In the scenario Hal only agreed to a trail by Non-Linear Pro.
Contract Formation
“A contract is a promise or a set of promises for the breach of which the law gives or the performance of which the law in some way recognizes a duty” (Cheeseman, 2010. p. 153). There was no a contract between Hal and Non-Linear Pro only a conversation of a demonstration that he saw, which led to the use of Non Linear Pro equipment on a trial basis in one of the editing rooms. The agreement between the two parties was based on a 30-day trial. Subsequently after the trial, the parties may decide to negotiate a contract laying out cost concerns, delivery, and set-up training, and timing.
A contract is supported through deliberation defining something of legal worth. “According to Cheeseman the consideration can consist of money, property, the provision of services, the forbearance of a right, or anything else of value” (p. 181). The consideration makes the contract enforceable.
