OSHA Inspection
One of the major reason why a conference is initiated prior to commencing an inspection, is for OSHA compliance officer to review the nature of the alleged complaint and reveal the type of hazards violations as established in the complaint. It also allow EHS representative and compliance officer to review the stated-reason for OSHA inspection that takes into consideration the scope of the inspections. It is important to note that the scope of this inspection is limited to 2 out of the 5 buildings located on site. Therefore, this inspection is label as partial inspection. I will request the inspector to provide a warrant before addressing the safety violation he received from OSHA during the inspection. It is my right as an employer under the law to request a warrant. For example, the OSHA Act clearly explains, “an employer has a right to require that the CSHO seek an inspection warrant prior to entering an establishment and may refuse entry without such a warrant” (Department of Labor). The law required for OSHA compliance officers to broaden the inspection if it deem it necessary by observing hazards conditions. In this case, I will require OSHA to validate expanding the scope only with a citation or warrant. This will give me more time to conduct a safety audits and take corrective actions when the search warrant arrives.
I think that this is not a win win case, it about applying the law and making show that it is fully implemented. As an EHS officer, I will require that OSHA issue citation that will allow OSHA to establish an Informal Conference after issuing a citations, I will contest all citations because I have reasonable arguments justify the reason I am requesting a warrant to expand the inspection. I will also make sure that OSHA understand that I am addressing all hazards condition found in our work place and that

    1. What were the legal issues in this case? This case is based around the laws and regulations of OSHA. OSHA is an Occupational Safety and Health Act that has been put into place to ensure the safety of employees while on the job. These regulations are put into place to help reduce the number of on the job injuries and death. In this case, Williams Construction was put under investigation after a trench collapse, which resulted in the death of one employee and a serious injury in another. After the investigation Williams was charged with four OSHA violations that all resulted in expensive fines. The issues that arose from the investigation included; the failure to instruct employees and managers on how to recognize and avoid hazardous work conditions, the failure to ensure that employees did not have to travel more than twenty five feet to a safe zone, the failure to have a “competent person” that was specifically trained in trench safety and the final violation was the failure to make sure that the walls of the evocation were either sloped or supported. It is the belief of OSHA that if these regulations were followed that this tragic accident could have been avoided.
