Background

Fortin’s employer sells automotive replacement parts at wholesale from warehouses and distribution centers in the Eastern United States. Mrs Fortin began work at the company's Miami warehouse in 1986. From that time until her layoff in October in 1994 she held a number of customer service position. Because of her excellent reputation for providing service to customers, she was assigned to staff the Metro-Dade account, a separate account established to provide exclusive service to approximately 24 governmental customers in the metropolitan Dade County area. On June 1, 1994, Fortin appeared under subpoena to testify on the union's behalf at a representation hearing concerning the organizational efforts being undertaken at her workplace. She was quoted in the Miami Herald as saying the workers: "want to better ourselves". When she returned later to work that day, she received her first disciplinary warning ever. During June 1994, the employer issued four additional disciplinary warnings to Fortin. The employer also removed an exclusive telephone number with its voice mail capabilities used by the customers of the Metro-Dade county account to reach Fortin directly and ceased the special van deliveries to those customers. Fortin was held accountable for the ensuing decreased sales in that account. Notwithstanding this discipline, Fortin remained one of the union's most prominent vocal supporters. In early august 1994, her supervisor gave Fortin a negative performance evaluation in which she received an overall rating of two indicating "improvement needed". In October 27th, Fortin was laid off. Her new supervisor relied on the negative performance evaluation in deciding to lay her off.

This case addresses the problems in operating procedures and the difficulties of taking union relations into account in the modification of operating procedures. In particular, the case demonstrates the difference between operations planning and control. Normal fueling operations required 23 union employees. During a recent strike, when the FBO was negotiating the employment contract with these union employees, non-union managers performed refueling tasks. Fourteen managers handled refueling operations working 12 hour shifts, 7 days a week. While FBO would not expect union employees to work 12 hour shifts, or work 7 days a week, they do see evidence from this experience that refueling operations could be managed more efficiently.…

    1. Training - More than 85% of our employees are under union contract protection while most of our foremen have little knowledge of such contractual implications. As we look into our training programs, we have allowed this fundamental tool to fall into a discretionary action made by supervisors and managers that most times is only given in an informal way. Our present employee morale has shown negative effects in our rate of retention for our critical positions of foremen. As these positions are perceived as opportunities to grow within our company, our foremen (mostly promoted from within) have lacked;…

As an expression of a mother-infant bond, many different species learn to raise their young together or for the other family member, which is known as alloparenting. This bond allows for multiple influences on the infant, the mother, and the group as a whole. These influences are advantages in many ways, one if the mother perishes the infant stands a better chance of being taken on by another member of the family, two if the mother is needed to go out and find food or water, the child will be able to stay with someone until she returns, and three young females who keep other infants have a chance to further their own future parenting skills. The idea of alloparenting can be seen in many societies, but mainly in primates. . In the case of primates, where individuals other than the birth parents help raise, nurture, and in general interact with is called alloparenting.…

In today 's culturally diverse, politically correct society, it is hard to believe that at one time racism was not only accepted as the norm, but enjoyed for its entertainment value. Individuals of African descent in North America today take the large, diverse pool of opportunities offered by the film industry for granted. Much like Canadian theatre however, there was a time when a black man in any role, be it servant or slave, was virtually unheard of. It took the blaxpliotation films of the early nineteen seventies to change the stereotypical depiction of Black people in American Cinema, as it took The Farm Story, performed by a small troop of Canadian actors, to create a Canadian theatre industry. To be more specific, it took the release of Melvin Van Peebles, Sweet Sweetback 's Baadasssss Song, in 1971, to change the tradition view of Black people in American film.…
