Merritt Smith's Case Study
Merritt Smith's four-year-old daughter was hit by a boy at school. The boy hit her so hard that it broke her skin. Merritt decided to take her daughter to the hospital. When Merritt checked her daughter into the hospital, the receptionist told the girl that the reason the boy hit her was because he liked her. Merritt was disgusted by the comments. Walker was aggressive and pushed the officer, consequently leading to PC Adams arresting Walker for a public order offence. Walker made a claim in tort seeking damages for false imprisonment, assault and malicious prosecution. At first, the claim was dismissed for the reasons that the detention had been brief and the arrest is lawful since the claimant was aware of his arrest and ‘public order’ is an adequate reason for the arrest. Today was the day of the Dred Scott case. I was very nervous for what would happen. I’m from Illinois which is known as a free state.
