Shirley A. Little Wouldn’t Hurt!
Believe it or not but this case isn’t as unusual as it may seem. Society today has lost its understanding of “working hard for their money”. Reading this story seems to show so many signs of alert to me and would have thought that it would have been caught in the earlier stages. Many seemed to believe that “No not Shirley would hurt this company” and that is the problem. We tend to let our guards down and forget what the human minds are capable of. With today’s technology and the knowledge of the individual almost anything can be accomplished and that is those tools that can be the most evil.
Indeed Shirley may have been a hard worker and committed to her employer however; even with those characteristics you still should not have authority like she did. She was an above average employee that did everything expected of her and more. Her level of performance was above “normal” and there for she wasn’t a threat. She may be a good person and a hard worker however; those can be over ruled by greed. Shirley got away with it once and continued with a habit that lead to disaster for not only her but also the company. I doubt they will ever be reimbursed all those funds but I hope she set an example for others whom find themselves in that position. It is my belief that the individual that committed this offence is seeking what others have and this seems to be the only way to achieve that. We are a marketable society that wants what we don’t have and often try to find the easiest way to get it. Shirley clearly wanted and may have needed the monies to show her fellow people that she is well off and lives a higher standard life

    I feel that one major flaw in the Phar-Mor company is the fact that Mickey Monus has full control of the company and could pull off such a giant fraud scam. This is a flawed system in management. There were no checks and balances to keep this fraud from happening. Mickey Monus had so much control of those under him that he convinced them to go along with the fraud. That everything would get better soon and they would not have to worry. The ones that did know about the fraud were in a position to say something but chose not to. If the company were structured better, another manager or high level authority would have caught the fraud being conducted and stopped it in its tracks within management. This in turn leads to the second flaw which is in the corporate governance. There had to have been a separate board of directors that should have had the capability of finding the fraud themselves instead of letting one man hid it from them. The company had audits being made but they were very poorly executed. The audits should have been made at random and more frequently. Only checking four stores out of 300 every once in awhile is not enough. However, the management structure should have been set up better so that they could catch the movement of inventory to the audited stores. For the amount of money that was being lied about way too many people should have caught on to the fraud much sooner. When Cherelstein and Finn both first found out about the fraud it should have been reported to the board of directors. They would have been able to relay the information to the proper places.     Karen Silkwood took a big risk when she decided to blow the whistle on Kerr-McGee in 1946 for health and safety violations. Silkwood was concerned about her and her coworkers’ health and safety as she witnessed various health and safety violation acts that management ignored. Whistle blowing can be very dangerous for the one that is blowing the whistle as witnessed by the mysterious death of Karen Silkwood on the night of November 13th.     The scenario is about Sara Patel; she has finished college and is working in a company called Maddison for three years. The first two years she had worked in sales department but now she is working as a sales trainer in the sales and development department.     Within this case little three year old Joshua was mailed an offer by times magazine. Within the see through window of the envelope there was an offer stating that if the recipient only opened that letter that they would receive a free calculator watch. After his mother opened the envelope and read further it seemed that not only opening the envelope but purchasing the magazine was required to claim this prize. The first question that this case asks is did Time act ethically in this case. My answer to this is no, the displayed false advertisement by stating all that the recipient needed to do was simply open the envelope to receive their “gift”. They were giving false information as not only did you have to open the document but you needed to subscribe to their magazine in order to receive the calculator watch. The next question that was asked was what a frivolous lawsuit is. A frivolous lawsuit is when a case is brought to court and it is lacking substance and not worth serious consideration. Was Joshua’s lawsuit a frivolous lawsuit? In my opinion no it was not as Time Inc. needed to be shown that false advertisement is not going to be tolerated. Lastly the final question in this ethical case study is was the claimed damages of $15 million excessive? I believe that this was not excessive as when you are dealing with a well known profitable company the only way you can get through to them is by hitting them where it hurts and that is at the bank. By being awarded that settlement I am sure that Time Inc would not only try to appeal the decision but it would make the company remember for future reference that giving false advertisement can cost them a ton of money.…
