Week 3 You Decide

1. You are the judge in the case. Does Susie have a case against Ruthless? Is Ruthless the proximate cause of Susie’s injuries?

I certainly do think that Susie has a case against Ruthless because of the simple fact that Susie told Ruthless that she wanted to wait for Orson or she could walk home since she only lived six blocks from the park, but Ruthless paid no attention to Susie, he did not acknowledge what she said and gave her no choice but ordered everyone to get into the truck. Officer Ruthless could have stayed with Susie for a few minutes to see if Orson would come and pick her up, if not, then Officer Ruthless could have easily driven Susie home to ensure that she arrived safely at her home. If Officer Ruthless had other duties that he had to tend to, he could have easily called Susie’s parents to come and pick her up or called his supervisor to tell him that he was running behind because he needed to take a minor home, I’m sure that his supervisor would have understood and all of Susie’s injuries could have been prevented. I believe that Ruthless was the proximate cause of Susie’s injuries because he was the one who ordered her to get into a vehicle that she was refusing to get into from the beginning. Susie has every right to file a complaint against Officer Ruthless, the Elsewhere Police Department because Officer Ruthless is their employee and also Jerry for being careless in driving the truck. Even though a police officer is not obligated or can be held liable for failure to protect a citizen, I do think that he should have not ordered Susie to get into a vehicle that she was refusing to get into. I believe that if Officer Ruthless could have given her a ride home on his way to tend to his other duties that he claimed to have, Susie would never have sustained any serious

    After watching the series of videos for the assignment this is what I have come up with this for the assignment. The case that we are observing took place in the United States District Court in the Northern District of Indiana. This is court case number 82A04-8876-CB285, White vs. Patrick Gibbs and O’Malley’s Tavern. The lawyers in this case are Benjamin Walton, and Mr. Van Meter who represent the defendants Patrick Gibbs and O’Malley’s Tavern, as well as, Jackson Welch and Amanda Babot who represent the plaintiff Debbie White. They are a group of four very impressive first year law students. The case is based on an incident that occurred when Mrs. White and her husband, Mr. White, were having dinner at O’Malley’s Tavern. Mr. Edward Hard, Mrs. White’s ex-fiancé was also at O’Malley’s Tavern that night. It was noted that he had consumed a considerable amount of alcohol. When Mrs. White and her husband left the tavern, Mr. Hard stumbled out of the tavern behind them, got into his vehicle, hit several vehicles, and chased the Whites’ out of the parking lot. Within roughly a half of a mile, he drove into the side of their car, killing Mr. White and injuring Mrs. White. The plaintiff Mrs. White believes that O’Malley’s Tavern is also partially responsible and should have intervened with Mr. Hard and not allowed him to leave intoxicated. The defendants are seeking a summary judgment which is a procedural device used during civil litigation to promptly and expeditiously resolve a case without a trail. They are claiming that there is not sufficient evidence to support that the bartender saw any visual signs of intoxication from Mr. Hart. However the plaintiff Debbie White is requesting the court to deny the defendants request for summary judgment.
