The judge has made a judicial error by allowing the Plaintiff's counsel to comment on the case about Minichiello's boss being a German with an "attitude of hatred" and made forced analogies to Nazi Germany and the Holocaust. The judge also allowed irrelevant testimony, which asserted that the Club discriminated against Latinos, Jews, and African-Americans, to the issue of discrimination based on sexual orientation. I agree that awarding $20,000,000 was grossly excessive and has no rational basis, and was an error by the judge as well.…

It has been proposed by a number academics that environmental law has failed in its most basic purpose:1 to keep anthropogenic activities in compliance with nature’s limits. Because of this, climate change is frequently described as a ‘super wicked problem.’2 These are a new class of global environmental problems which defy resolution due to their interdependency and uncertainty. They are characterised by three prominent themes: firstly that time is valuable and it will eventually be too late, the hypocrisy of those causing the problem are those seeking a solution, and finally the central authority needed to address them is weak to non-existent. Pairing this with underlying assumptions of the legal order, there is potential to demonstrate…

However, now the mindsets are changing and now we realize that the message of the people’s welfare contained in article 38, 41 and 43 of the Indian constitution are essential for development. The main idea behind these constitutional directives is that it makes it the duty of the state to bring equality among the citizens of country and ensure that all the people are able to have at least the basic necessities of life. The implementation of these articles gives a message that environmental protection and ecological preservation embodied in article 14, 21 , 47, 48A and schedule 5 and 6 of the constitution cannot be taken for granted. The balance between environment and industrialization is very important. India being a developing country needs rapid industrialization, and no doubt there should be industrialization but it need not be at the cost of environmental damage. The other thing to be kept in mind is that industrialization should not hinder the overall progress even for future generation. It happens quite often that the regime is unable to foster coordinated action in the given setting of the actors, resource attributes and technology. It is difficult to execute the law in a country like India, where every actor has their definite interests, and the infection of corruption is everywhere among the bureaucrats, construction companies, technical experts, politicians, environmental consultants, and aid agencies. Politicians help construction companies get the contract of the project in return to large amounts of money, and bureaucrats help them with the legal formalities. Other actors: technical experts and environmental consultants too get mixed in this storm of corruption to protect their jobs. In addition to the interaction of these actors to worsen the fate of the project, we will now try to explore how the government interacts with the states to settle the interstate water…
