Based on the stated evidence, the defendant suffers from hallucinations, acute hearing, and lack of sleep which all can lead to being mentally insane. We believe that due to him not being in the right state of mind which had lead him to kill the old man he should not be sentenced to death but should spend time in a mental hospital. Therefore at the hospital, they workers will try to solve his insanity. After his time in the mental hospital and his insanity cleared up, we believe he should be sent to jail for to accept his time from killing the old

    After reading the case study I found that the state statute that used was the Texas Penal Code section 42.09(a)(3). This statute prohibits the desecration of a venerable object. For example the American Flag or any object that has significant meaning. The Judicial Branch of Government created the state statute, and that parties that were involved in this court case was Gregory Lee Johnson and the State of Texas.
