Holding Shay's Back: A Case Study
I appreciate the time that you took in emailing me to inform me you were my son Shay's principal. I left a voice message and sent an email to you on 5/16/2016, also I did try contacting again on 5/17/2016. Do to not being able to make contact with you yet I decided sending an email explaining the importance of needing to speak with you. Shay has been recommended for retention which I disagree with the recommendation. Therefore, speaking with I believe we will be able to find the best solution for this matter. Holding Shay back is not helping him but apunishment. Shay is entitled to a free appropriate public education, therefore if Shay is that far behind I would believe his IEP is not working and it's time to update and amend it.

His current Fountas and Pinnell (F&P) reading level is a D, which is on grade level for entering first grade. He was retained last year and currently remains with his former teacher from the previous school year. The decision to retain was based upon low academic performance, as well as his age (December birthday). Targeted goals and areas of improvement this current year include: classroom routines, transitions, and social skills, such as developing appropriate relationships with his peers. Literacy goals include decoding and building phonemic awareness, such as isolating letter sounds. He currently has an IEP in place under the label of speech and language…

The school board was accused of predetermining not to offer Zachary ABA on any level, regardless of how beneficial it was which violated IDEA (United States Court of Appeals, 2009). Additionally, Zachary 's parents were not fully involved in the IEP process which deprived Zachary a FAPE. At one IEP meeting Zachary 's parents were informed that they were not allowed to ask any question which goes completely against parental rights (County Schools, 2005). The IEP meetings also failed to have a general education teacher present. The Deals began their administrative hearing in March of 2000. In October of 2001 they initiated a review of portions of the ALJ 's decision in district court. Finally in December of 2004 the courts decided a verdict. The decision had been made to reimburse the Deals 's with the money they had spent on private ABA and related services (United States Court of Appeals, 2009). Sadly, it took years in court and an estimated 2,2850,000 to defend a relatively small reimbursement claim (County Schools,…

Regardless of what the court said, it is my understanding that a school district is not responsible for providing services to a student outside of the normal school hours. However, it is also important to note that each student has goals that are written in the context of a student’s IEP. If the school district is seeing progress in the student’s goals, there is no need for further action. In the…

With fights broke out daily, with trash being thrown on the ground. IEPs are required to include certain information including, but not limited to, the child's current level of performance, goals, accommodations, modification, services, and least restriction environment explanations. They would ever call me a liar for asking for books (because it was in the IEP) or study guides for tests. They wouldn’t even modify the tests, which have it read to and/or have two answers choose instead of four. As you can see they're not really taking the responsibility for your child receives special education services, they must have an Individualized Education Program (IEP).…
