What is the law?

It is rare that a law can be both momentous and anticlimactic, but Tuesday 's 158-133 vote to change the legal definition of marriage qualifies. It is a happy step forward for Canadian society, which, through its elected representatives, has voted to welcome same-sex couples into the marriage tent. If the Senate passes the law, as it is expected to do early in July, gay and lesbian couples across the country will be legally entitled to receive civil marriage licences. Parliament will have rejected any notion of a "separate but equal" arrangement in which gays are relegated to a civil union rather than marriage. As Prime Minister Paul Martin said, "Separate but equal is not equal."

Do gays and lesbians have the adoption rights? many states have allowed lesbians and gay men to openly adopt (meaning to be open about their sexual orientation, not necessarily to engage in open adoptions) since the last years of the 20th century. Many American adoption agencies, both public and private, had been allowing, and often encouraging, fostering and adoption by gay and lesbian parents prior to legislation specifically sanctioning the practice. Of those that have legalized adoption by homosexuals, some states allow non-heterosexual couples to adopt together, and others require a second-parent adoption after the initial finalization. Every state except Florida permits single gay and lesbian parents to adopt. Public agencies dedicated to the welfare of children and youth in several states anecdotally report that it is beneficial to recruit gay and lesbian parents because they are typically older, more financially stable, more apt to be attuned to psychological concerns of their adopted children, and far less willing to allow an adoption to disrupt (not succeed) than their heterosexual peers.
