In February 1998 12 year old Tiffany Applewhite went into anaphylactic shock and her heart stopped after a nurse gave her a shot of steroids for an eye condition in her family’s apartment. Tiffany’s mother called 911, and the city sent two medics in an ambulance. That ambulance didn’t have the advanced life support equipment that Tiffany needed, and the paramedics failed to bring oxygen or a defibrillator. Tiffany’s mother had pleaded with the paramedics to take her daughter to the nearby Montefiore Hospital. Instead, they advised her to wait for the private ambulance with advanced life support equipment to arrive. When that ambulance arrived 20 minutes later, paramedics gave her epinephrine and oxygen and transported her to Montefiore. She…

Thank you for contacting the BACB concerning your background and certification requirements. The BACB does not have a specific set of criminal charges that determine whether someone qualifies for certification, rather the BACB will review the individual’s record and make a determination. However, the BACB is aware of the rigorous background check process the California Department of Justice conducts for person working in positions of trust, and, therefore would defer the decision employment as a BCBA/BCaBA to California law and the employer’s requirements. Nevertheless, if you would like us to review your records, please forward the records in PDF format to BACBlegalreporiting.com.…

The issue here is that employers will often discriminate, against former criminals during the hiring process. It is almost impossible to even get an interview if someone has to indicate that they have a criminal record on a job application. To make matters worse, a released criminal will be hit with a bevy of fines and payments that need to be made to the state ranging from public defender fees to expenses incurred in prison. As if living on minimum wage, without government help, and with little to no job security wasn’t hard enough, these fines make it nearly impossible for people to support…

Why do I believe you should hire a felon? It’s been said that when somebody has something to prove, they will move mountains for you. How much does an individual coming out of a situation such as prison have to prove? Plenty. Not only to you as an employer, not only to society in general, but also to his family and everyone else who doesn’t believe that someone who has been imprisoned can make anything of themselves in life. President Kennedy stated in an article titled, Address to the American Newspaper Publishers, "An error does not become a mistake until you refuse to correct it. We intend to accept full responsibility for our errors; and we expect you to point them out when we miss them” (Kennedy). Why should anyone feel that any individual who has made an error in their life be denied the opportunity to provide for his or her family? Do I believe that this is an error? Yes, and I plan to point it out.…

There is an array of tools employers use to examine and decide on job applicants and employee job promotions. Typically they will contact references, verify educational and/or professional history, request a criminal history report and in certain situations obtain an individual’s credit history. For some this can create a barrier in the search for employment. A study made by the Society for Human Resource Management (SHRM) in 2010 reported that 47 percent of respondents only use credit background checks for job applicants in certain types of positions, for example, positions with fiduciary and financial responsibilities (SHRM, 2010). Thirteen percent of those surveyed conducted credit checks on all candidates while 40 percent in the SHRM study reported that they did not utilize credit checks on any job candidates (SHRM, 2010). This…

The first objective of the study was to find out whether and to what extent employers use information about criminal history in making hiring decisions. This was important because in the sample taken by Pager (2003), 27% of employers said they would perform background checks on all applicants. However, the actual number was most likely higher because employers were not required to indicate whether or not they intended to perform background checks (Pager, 2003, p. 953). And although not all employers actually do this, it still implied that, to some degree, a criminal history will affect job opportunities. One criticism to this type of research was that employers use other characteristics to determine whether or not the applicant will be hired and not the criminal record. This says that the same characteristics that make a person resort to crime happen to overlap with…
