FOR AND IN CONSIDERATION OF the payments and mutual covenants set forth herein, KIM COOPER, as Mother and Legal Guardian of ALLISON A. Confidentiality. Plaintiff, Releasors and their attorneys, The Law Offices of Frederick W. Nessler & Associates, Ltd., agree that the terms of this Settlement Agreement, including the amount of the settlement payment, shall be kept confidential and will not be disclosed or released by them to any entity or person, except as required by law, such as for Medicare reporting, in order to obtain court approval of the settlement, or as otherwise ordered by a court. To the extent that disclosure to any governmental authority, court or other entity or person is required, Plaintiff and Releasors agree to take all necessary steps to ensure that the terms and conditions of this Settlement Agreement are kept confidential and will not be disclosed publicly. The sole consideration for the confidentiality of this Settlement Agreement is FIVE HUNDRED and NO/100 ($500.00), which Plaintiff and Releasors agree and acknowledge is included in and part of the TWO HUNDRED FIFTY THOUSAND and NO/100 DOLLARS ($250,000.00) settlement amount set forth …show more content…

Schumate was a mentally retarded student that attended a school specifically for his disability in Cypress Fairbanks School District. As stated in Walsh, Kemerer, and Maniotis (2014), “Cary’s teacher directed the teacher’s aide, who was a mentally handicapped person, to take the class outside to play. The aide was given permission to choose the activities for the students.
