The term false advertisement means “an advertisement, other than labeling, which is misleading in a material respect; and in determining whether any advertisement is misleading, there shall be taken into account (among other things) not only representations made or suggested by statement, word, design, device, sound, or any combination thereof, but also the extent to which the advertisement fails to reveal facts material in the light of such representations or material with respect to consequences which may result from the use of the commodity to which the advertisement relates under the conditions prescribed in said advertisement, or under such conditions as are customary or usual.
No advertisement of a drug shall be deemed to be false if it is disseminated only to members of the medical profession, contains no false representation of a material fact, and includes, or is accompanied in each instance by truthful disclosure of, the formula showing quantitatively each ingredient of such drug.
In the case of oleomargarine or margarine an advertisement shall be deemed misleading in a material respect if in such advertisement representations are made or suggested by statement, word, grade designation, design, device, symbol, sound, or any combination thereof, that such oleomargarine or margarine is a dairy product, except that nothing contained herein shall prevent a truthful, accurate, and full statement in any such advertisement of all the ingredients contained in such oleomargarine or margarine.” (15 USCS § 55)

Advertising agency agreement is a legal document that defines the relationship between an advertiser and its advertising agency. An advertiser is a person or company that places advertisements in order to target customers. The advertiser engages an advertising agency to create advertising work for him. By an advertising agency agreement, all rights to the work created by the advertising agency are assigned to the advertiser for their uses. In return the advertiser agrees to pay the agency certain amount. The agreement covers what services will be rendered, fees and payment structure, and ownership and use of content developed during the term of the agreement.

In today's society, one must consider - Is there any advantage of advertising?
In many cases it is only disadvantage - an anoying hinderance in our daily lives.
It gets on our nerves, distorts the truth, and adds to the cost of the product.

Advertising is designed for one purpose - to sell. To acheive this goal, advertises are willing to stretch and distort the truth, just to convincing people to buy their product. For example, an advertiser may convince buyers to purchase their product by stating that has been tested and found superior. In reality, the product is not likely to be beter than any other - the tests themselves doubtlessly conducted by the promoting company - conducted to ensure at least something is superior about the product, even if it is only the colour.

These advertisments are worded carefully so that they are telling the "literal truth" - the truth is exactly what the words say, although people misinterperete the message by using conversational logic as something different - something better. By using ingenious tatics like these, the populace is decieved into buying a product that may not do what is required, or a product which a buyer may have never really needed. This is why advertising is a bad thing, for our society.

To begin with,advertisements provide consumers that know about goods in the global market.When a new product is produced,people can be aware of this thanks to advertisements.With developing technology,these advertisements attach more attention of people.In addition,advertisements provide huge incomes for TVs and newspapers.We can see a lot of adversitements while we are watching a film or serie on TV.Channel directors are using these in popular programmes.So,manufacturers find chance to show their products to more people.
When it comes to help selling goods to a bigger market,advertising has a huge role.Markets can be aware of products which are shown in effective advertisements.Thanks to this,markets decide to buy these products and producers sell more goods.Furthermore,when markets have more product stock,they sell these products cheaper.So,this also can help consumers' economic situations.Owing to advertisements,economic growth become more effective.
On the other hand,some opponents to advertisements claim that these do not give more informations about products.For example,they do not know what there is in a food.Advertisements do not inform people about preservatives and additives in food.However,advertisements mostly have responsibility to sell and present the goods with visual objects.Manufacturers pay for advertisements to show their goods much more people.So,advertisors should make creative advertisements to show products' obvious features.
Having said all these,advertising have useful aims to inform public and provide incomes to manufacturers.Some people argue that advertisements are not really needed and do not give much informations about goods.However,these are helpful for people to be aware of goods and economic growth.Thanks to creative and effective advertisements,public awareness and competition among manufacturers can continue to be provided.

Throughout mass media there are illegal messages that still appear, such images are also known as Subliminal Advertising. Though illegal, such incidences can never be tried nor taken to a court of law. It is highly impossible and unlikely to notice these messages. However, they are triggered by the subconscience and send neural messages to your brain that you are unaware of, thus making it hard to notice when you are seeing these things. They are illegal because it was believed in earlier incidences that cigarette ads were sending similar messages telling the youths of America to smoke.

I have witnessed similar messages called "Threshold Messages", these are images that are digitally re-mastered so that you don't notice what you are seeing but the neural pathways in the human brain hone in on and receive these messages.
