One of your direct reports, Robert, belongs to a fundamentalist church. While you have no problems with anyone's religious beliefs, Robert is so vocal about his religion that it's becoming a problem with other employees in your department. He not only preaches to his fellow employees, but also he has criticized the attire of some of his female co workers, and continually quotes the bible in staff meetings. You've received complaints about his behavior from several employees. A few weeks ago, you suggested to Robert that he tone down his preaching, and he reacted as if you were a heathen about to persecute him for his beliefs. His behavior has since escalated.

It’s important in this situation to understand the line that needs to be drawn between acceptable diversity and harassment. It is my job as the manager to find a balance between respecting Robert’s religious beliefs while also protecting the rights of all of my employee’s. Finding a balance of acceptable diversity in the work place and the respect of the organization as a whole would be where the ethical issue comes into play. Since I have already addressed Robert about my concerns of his flamboyance about his religious views and he has ignored my warning, it would be the best option to document his behavior. I think it would be important to stress to Robert that while we respect his religious beliefs, he in return has to respect the feelings and religious beliefs of his fellow coworkers. I would try to be as sensitive as possible to Robert’s feeling because religion in the workplace can be a sensitive subject to discuss. However I would stand firm behind why I will have to take further actions to document his behavior. While the conservation could go either way and Robert can choose to head my advice or go off the deep end and maybe get hostile, I would definitely address the issue in private. Would also try to get Robert to understand how his actions are making his employees feel. Maybe this

As you are embossed in this culture, you begin to take on the traits, beliefs and practices associated with it. You are fully immersed into your religion which now becomes second nature to you. You are taught that God helps people in need and looks out for all those who worship him. As you grow older, you believe more and more that your religious practice is what gets you through. As you report in to your first day of work, you realize that it is all you have ever wanted and you pray to thank God for the opportunity that he has provided you. You feel a tap on the shoulder and there is your supervisor telling you that you cannot pray in the office as it is prohibited by company rules. Many of your co-workers see this and they approach you at lunch time. They all feel your pain because they too have been told that due to company policy they also could not practice their religion at work. This is a problem. You realize that growing up in a Utilitarian environment urges you to fix this problem for the greater good of all the people working in this office. Religion should be allowed in the workplace to ensure that all people are afforded the opportunity to worship as they choose, within guidelines.     In contrast to this case, there are cases where religion is favored over cooperation. In one example EEOC v. Red Robin, where Red Robin was against an employee with two tattoos of verses on his wrist. They told him that if he did not cover up his tattoos, he would not be able to serve. Red Robin argued in part that the employee had standards that the tattoos conflicted with the companies’ family image. The only evidence that Red Robin had against these tattoos was a statement saying that they “seek to represent a family-orientated and kid friendly image (Flake).” But since there was no evidence to point that the customers complained about the tattoos.     Title VII of the Civil Rights Act of 1964 is a federal law that protects individuals from discrimination based on religion. Religious discrimination is treating a person differently because of their religious believes. In this case Elaine Mobley, a member of the nonsectarian Unitarian Universalist Church, can file a legal sue under religious discrimination or the Civil Rights Act of 1964, because she was discriminated by employees and her supervisor. They said that she would be “making efforts repeatedly to “save the soul” of a fellow employee” (Neill, 2014, Web). A proven wrongful dismissal will tend to lead to two main remedies: reinstatement of the dismissed employee, and/or monetary compensation for the wrongfully dismissed. In this case the court should look on how Elaine Mobley told her supervisor that she was feeling harassed by her employees, and shortly after that she was fired. In this case the judge should rule in favor of Elaine Mobley, because of what we have of the case it seems that she was being harassed and told her director of division and did nothing but fire her.     This brief synopsis as a human service worker in which I make every effort to help people, groups, and communities to triumph over their issues and struggles. As a human service worker I almost certainly would come across many ethical predicaments that involve susceptible issues such as discrimination, social unfairness, and oppression, poverty, substance abuse and mental health issues. As a human service worker or provider my personal principles may become an ethical difficulty with reference to discrimination of any sort because of my private belief but of course I am conscious of how many ethical standards that can be challenged if I allow my individual view to develop into concern.     According to Title VII’s religious discrimination clause (eeoc.gov, 2011), we certainly have an obligation to our employees to provide reasonable accommodations, like flexible scheduling. If the employee could not work, for example, Friday evenings through Sunday in observance of the Jewish Sabbath, we certainly could have found several ways to accommodate the employee by transferring him or her to an appropriate position as one of the office staff.
