Equal Employment Opportunity Commission (ADA): A Case Study
The U.S. Equal Employment Opportunity Commission (EEOC) filed a lawsuit in 2014 against American multinational conglomerate Honeywell International Incorporated. The EEOC claimed the company was violating the Americans with Disabilities Act (ADA) and the Genetic Information Nondiscrimination Act (GINA) by using biometric screening as a component of their corporate wellness program. GINA prevents discrimination against workers by their employers based on the employee’s and their family’s genetic information. One of the questions involved with the issue is what makes a wellness program voluntary under the ADA, in the light of the Affordable Care Act (ACA).
