This essay will examine the ethical and legal aspects of the Eli/BIC v Wally case. In this Case there are two ways to look at this scenario, which is to look at it legally and ethically. In legal aspects Wally cannot be sued because he is covered by limited liability, which protects from losing more assets than he invested. In Ethical perspective BIC should be able to sue Wally because he should be responsible for what happens to any of his businesses. Even if it means to lose some assets it would be the right thing to do. In Wally’s current sate he is neglecting his businesses and not showing any signs of care. We can also see that Wally was unethically wrong in his actions. So how can he fix it? The first ethical reasoning BIC can use to resolve the legal issue is that Wally has shown negligence toward his businesses. How is that possible? Wally structured his corporations so he does not lose many assets. He’s allowed some of the businesses to have more assets than others. This make his some businesses not equal to the others. Wally should have distributed is assets fairly so that if Wally’s electrical was sued they would have had enough assets to pay for themselves (Mac Donald, 2014). Doing this will allow Wally to have good character because good character comes when someone does the kind thing for something else. For Justice to be right fully served Wally would need to sacrifice some of his assets to help Wally’s electrical and take action for what Wally’s electrical has done (Mac Donald, 2014).
