The World Trade Organization, (WTO), is the primary international body to help promote free trade, by drawing up the rules of international trade. Its main function is to ensure that trade flows as smoothly, predictably and freely as possible. However, it has been mired in controversy and seen to be hijacked by rich country interests, thus worsening the lot of the poor and inviting protest and intense criticism. Where countries have faced trade barriers and wanted them lowered, the negotiations have helped to open markets for trade. But the WTO is not just about opening markets, and in some circumstances its rules support maintaining trade barriers — for example, to protect consumers or prevent the spread of disease. (Subramanian & Wei, 2007).…

The World Trade Organization (WTO) was established and incorporated in January 1st 1995 at the amendment of the General Agreement on Tariff and Trade (GATT) in 1994 with the aim of regulating international trade. The creation of this organization clearly underscored the acceptance and commitment of trade liberalization by most of the international communities. Upon signing and ratifying the WTO Agreement, each member state of the WTO committed itself through a series of agreements to ultimately liberalize its trade in goods, services and trade-related aspects of intellectual property rights. Each member state signed the WTO Understanding on Rules and Procedures Governing the Settlement of Disputes as well as the Agreement relating to the Trade Policy Review Mechanism (TPRM). This action required member states to periodically subject their national trade and economic policies for examination to ensure that their respective mandates are in keeping with the WTO's commitments. (Strategic Plan of the Foreign Trade Division 2002).…

The General Agreement on Tariffs and Trade (GATT) 1947 functioned as a means of adjusting trade relationships between countries trying to improve their economies. Contracting parties to this agreement have been bound by it to treat other contracting parties on an equal and reciprocal basis as well as to curb protectionism. At the start of 1995, the GATT has been succeeded by the World Trade Organization (WTO) and has since been the most important development in international trade. However, it is still essential to note that the GATT as amended is still the central piece of the WTO law .…

In an era of globalisation when states are becoming increasingly interdependent, regionalism is seen as an intermediary stage for further multilateral trade liberalisation. There are, however, two types of regionalism. One is discriminatory where there is free trade amongst the members of the region but non-members are excluded as in the case of free trade areas, such as the North American Free Trade Area (NAFTA) and customs unions, such as the European Union (EU), and the third type are preferential trading areas. The other, which is compatible with the most-favoured nation (m.f.n.) rule of the World Trade Organisation (WTO), is "open regionalism" which allows non-discriminatory trade between members and non-members of the region. In other words, the gradual elimination of internal trade barriers within a region will be implemented at more or less the same rate and on the same timetable as the lowering of trade barriers towards non-members (Ruggiero 1996). Hence, paving the way for greater multilateral trade liberalisation.…

With a system as the WTO agreements that are so complex, it is expected that there are many critics. Some consider the effects that occur from decisions made out of these agreements as deliberate attacks on those Member countries that are not considered as “most favoured nations” or MFN (developing countries). The WTO addresses these concerns and view these criticisms as fundamental misunderstandings of the ways they work. The WTO is a forum through which countries can thrash out their differences on trade issues - individuals can through their governments, participate in these discussions or debates but must do so based on proper understanding of the workings of the system. These include; The WTO dictates policy; The WTO is for free trade at any cost; commercial interests take priority over development and over the environment and over health and safety; The WTO destroys jobs, worsens poverty, small countries are powerless in the WTO; The WTO is the tool of powerful lobbies; weaker countries are forced to join the WTO and The WTO is undemocratic.…
