Drunk Driving Case Studies
INTRODUCTION:

This case involved Suspect Alexander Mulato being arrest for driving under the influence of alcoholic beverages.
LOCATION DESCRIPTION:

This incident occurred at the Langham Huntington Hotel and Spa located at 1401 S. Oak Knoll Ave.

INVESTIGATION:

On Friday, November 27, 2015 at 10:49 pm, Officer Alvarado #0347 and I responded to 1401 S. Oak Knoll Ave for a male unconscious in the driver's seat of a running vehicle. Upon our arrival, I saw a male Hispanic, later identified as Suspect Alexander Mulato standing chest first against the driver side rear bed of a 2008 Toyota Tundra California license plate #8M97877. The vehicle was parked facing south near the hotel's front fountain. Security Officer William Martinez was standing with Mulato. I approached the vehicle and felt that the engine hood was warm to the touch.

I spoke with hotel parking attendant Witness Matthew Ayers and he told me the following in summary: Ayers was standing outside of the front entrance of the hotel and heard a vehicle horn being used. Ayers looked toward the hotel's main driveway and saw a gold Toyota Tundra slowly driving into the hotel followed by eight additional vehicles. Ayers observed the vehicle come to a slow stop near the hotel's front fountain.

Ayers walked to the drivers front door and saw Mulato in the driver seat with the engine was running.

I arrested Mulato for CVC 23152 (a)/(b)- driving under the influence. I advised Mulato of his obligation to submit to a chemical test. Mulato understood his choices and agreed to take the blood test. As I was handcuffing Mulato, I observed him urinating on himself. The handcuffs were double locked. At Mulato's request, the vehicle was left parked in the hotel's valet

A Missouri police officer stopped Tyler McNeely after observing it exceeding the posted speed limit and repeatedly crossing the center line. The officer noticed McNeely’s bloodshot eyes, his slurred speech, and a smell of alcohol on his breath. McNeely performed poorly on a battery of field sobriety tests, and he declined to take a Breathalyzer test. When McNeely indicated he refuse a breath sample for testing, the officer took him to a nearby hospital for blood alcohol test. The officer explained to McNeely that under Missouri’s implied consent law, refusal to submit voluntarily to the blood test would lead to an immediate one-year suspension of his driver’s license and could be used against him in any future prosecution. The testing of the blood indicated that the blood alcohol level was significantly above the legal limit. McNeely had challenged the blood test evidence claiming that there should have been a search warrant before ordering a blood sample.…

Hedge animals have moved, the elevator that started with the sound of people talking about a party, the blood on the wall, and the lady in room 217 who sleeps in the tub. It had been noted that a lot of colorful people have indeed stayed at this hotel before. There were mafia, drug dealers, and so on and so forth. It would not be a surprised if someone had died here before. Both Jack and Danny have seen the hedge animals move at different times. They never actually see them more, but when they look over they are closer. The lady in the tub was seen by Danny, when he went in there after Hallorann told him not to. She was the only thing that physically was able to grab him with a grimace. “Still grinning, her hug marble eyes fixed on him, she was sitting up (King 320)”. My evaluation is that the hotel is haunted. That is obvious, though it seems like there are only a few spirits, or ghosts, that are bent on hurting them. Some, like the people at the party, just don’t mind them at all.…
