double taxation agreement
Double Taxation Avoidance Agreements (DTAA)
The Double Tax Avoidance Agreements (DTAA) is essentially bilateral agreements entered into between two countries, in our case, between India and another foreign state. The basic objective is to avoid, taxation of income in both the countries (i.e. Double taxation of same income) and to promote and foster economic trade and investment between the two countries. The advantages of DTAA are as under.

ADVANTAGES AND DISADVANTAGES OF DOUBLE TAXATION AVOIDANCE AGREEMENTS
Advantages
1) Lower Withholding Taxes (Tax Deduction at Source)
2) Complete exemption of income from taxes.
3) Underlying tax credits
4) Tax sparing credits
5) Formulating the fair Arms Length Price or the Transfer Price for the transaction
Disadvantages
1) DTAA are signed with only a few countries. So, the country with which no DTAA is signed, the income from that country will be doubly taxed.
2) It’s a cumbersome procedure to arrive at the Arms Length Price and depends upon the discretion of the Transfer Pricing Officer (TPO).

WORKING OF DTAA
In order to provide tax relief to avoid double taxation, various countries have entered into Double Taxation Avoidance Agreements (Tax Treaty). One of the ways to avoid double taxation is by way of an exemption from tax in the source country where the income is accrued or received. In the context of India, a tax resident of a tax treaty country (say US) can claim tax exemption on his salary income in India for his short stay in India irrespective of whether the income arises or is received in India. This implies that the tax payer has to be tax resident of US and Non Resident (NR) in India.
Hither to the recent changes in Indian tax law, NR taxpayers were not required to obtain and/ or furnish proof of being tax resident of a tax treaty country. Recently, India has amended its tax laws, vide Finance Act, 2012, to mandate NR taxpayers to obtain Tax Residency Certificate (TRC) if they are claiming

Tax havens generally exist to protect offshore profits and keep them a secret from governments. After The Economist published a special report named “Storm Survivors” about offshore finance problems, Jeffery Kadet proposed a “worldwide-full inclusion” system to fix the offshore financial problem. Most countries use “territorial” or “deferral” tax systems. Either system is better than Kadet’s “worldwide-full inclusion” system, because the “territorial” and “deferral” systems would prevent multinational businesses from shifting their money to tax havens. They would avoid making those companies pay double tax on foreign earned income to their home countries and to foreign countries. The “territorial” system also would give companies more competitive opportunities on a level playing field in the world. On the other hand, the “deferral” system would allow multinational companies to delay paying their income taxes on offshore profits; companies can use the deferred income tax money to expand their offshore business.…

As of 1 January 2001, South Africa's territorial system of taxation (or source-based system) was replaced with one based on worldwide incomes for resident companies, including resident branches of foreign companies. In order to preserve some of South Africa's appeal as an "off-shore" location for international headquarters, a separate regime for non-resident International Holding Companies (IHCs) is maintained which allows for income from foreign subsidiaries not to be counted in the IHC's tax liability (under Controlled Foreign Entity provisions in the tax law). South African holdings in a qualifying IHC cannot exceed 5% of total equity share capital. As non-resident entities, however, IHCs cannot avail themselves of the reductions and exemptions in withholding taxes from subsidiary companies that are available to resident companies through South Africa's network of double taxation prevention treaties. The result is a reduction in South Africa's appeal as an "off-shore" location and an increased use of holding companies in low-tax jurisdictions (tax havens) like Mauritius, the Channel Islands, the Cayman Islands and the Isle of Man) to hold portfolio investment and other assets by South African companies.…
