Death Penalty
Legalized Killing

Does the implementation of Death Penalty bring life, justice and end heinous crimes in the Philippines? I don’t think so. But the new Vice President of the Philippines Jejomar Binay thinks it so as he utter his desire to bring back death penalty in the Philippine in his outburst emotional response when he attended the wake of the brutally murdered son of attorney Oliver Lozano at media interview.
“Dapat ibalik na ang death penalty…” ( “It is high time to bring back death penalty”) —-Jejomar Binay
Death Penalty has been in the Philippines since the Marcos administration but was only removed at the time of former Philippine president Corazon Aquino and was revived during between the administration of former Philippine presidents Fidel V. Ramos and Joseph Ejercito Estrada and was removed again at the time of the recent former Philippine President Gloria Macapagal Arroyo because of the mistake and failure of the execution of the First ever Filipino to receive death penalty by lethal injection –Leo Echagaray for the crime of rape which was found eventually that he is not guilty or was innocent of the crime he was accused of and the true rapist is at large and unknown. What a big slap on the Philippines justice system, thus it was removed. It was the roar and pro-death penalty campaigns in the media which influenced unlearned people that Leo Echagaray succumb into untimely death before he was proven innocent; so sad that people at that time were driven by brainless wrath to revenge for the rape victim.
But now Vice president Binay, is wishing to bring it back? ; To repeat this “sad scenario” just to tell to the world that “we do justice”, WHAT JUSTICE?? Does he think well when he utters a wish for its revival or is he just emotional overwhelmed at the wake of the brutally murdered son of attorney Oliver Lozano?
There are many bad consequences to the justice system of the Philippines when Death penalty will be rekindled its frightening presence

Costs and Consequences of the Death Penalty, written by Mark Costanzo, neatly lists reasons for opposition, and abolishment of, the death penalty. Costanzo provides a review of the history of the death penalty, a review of how the death penalty process is working today, questions on whether or not if the death penalty is inhumane and cheaper than life imprisonment. He also questions if the death penalty is fairly applied and the impact, if any, that it has on deterrence. He closely examines the public's support of the death penalty and questions the morality of the death penalty. Finally, Costanzo provides his own resolution and alternative to the death penalty. Each of these items allows the reader an easy, and once again, neat view of how the death penalty can work against out society rather than for it.…

But the fact is the death penalty compared with other kinds of punishment, the death penalty does not deter crime has a special function. Offenders can be divided into two categories: Impulsive type and plan type. For impulsive, they are in the non-rational state at the time of crime, reckless commission of a crime, the death penalty cannot afford deterrent for them. For the plan type, there are too many elements need priorities than death, such as Benefits available on crime, criminal attitude towards his life and so on. Thus, the deterrent effect of the death penalty not prominent than other kinds of punishment. As some homicide, injury, rape, crimes were mostly due to some conflicts or situations stimulation, so that the loss of reason, impulsive, and at the moment committed a crime. In this case, the perpetrators are often impossible to accurately discretionary legal consequences of his crime may cause. For these people, the death penalty deterrence can be said too late to play. Furthermore, most of these people will regret afterward, in fact, sentenced these people to death runs counter to repentance, even those who escaped will continue to stimulate criminal psychology. Harsh Prison Sentences

Harsh prison sentences in countries like Iran and Indonesia are made to teach the general public that committing a crime is wrong and offenders will be punished. In Indonesia, being in possession of marijuana will warrant the offender a death penalty whereas South Africa can give you a heavy fine or a minimal sentence of approximately ten years depending on how much is on you when you are caught. With that being said, the family of the person who has been executed will seek revenge one way or another. Reason being, the death sentence is the same as murder to some thus more crime will be committed by family members seeking to avenge the death (execution) of their loved one especially given the circumstance of the crime. Every execution, one way or another, leaves behind a new victim and that does not help in reducing the crime rates in any country. For example, if the person that was executioned had a child, that child will grow up not understanding why their mother or father was killed and grows up to resent the world, leading them to start a life of crime. In the long run, crime rates will rise thus and the cycle starts all over again.…

As the merge of human rights associations, this punishment is strictly opposed for its cruelty and this has been a global debate for some years. In Malaysia, this punishment is proudly held in the law and until today, executions are being held. It is a great shame as all members of the United Nation were already called to join the moratorium of death penalty (Amnesty International, 2007). Many countries have abandoned capital punishment and Malaysia should do the same as it is inappropriate, cruel and it does not help the society in any ways.…

WE IN THE NEGATIVE SIDE YOUR EXCELLENCIES TRULY BELIEVE THAT DEATH PENALTY IS NOT THE KEY SOLUTION TO THE DETTERENT OF CRIMES., IN ACCORDANCE WITH THE STATEMENT OF THE DEPARTMENT OF JUSTICE “Justice that kills is not justice. The imposition of capital punishment has no positive impact on crime prevention or security and does not in any way repair the harm done to the victims and their families. WE BELIEVE THAT LIFE IMPRISONMENT IS ENOUGH WE ONLY NEED TO STRENGTHEN THE POLICE POWER HERE IN OUR STATE,BY EMPOWERING THE LAW ENFORCEMENT WE CAN ENSURE THAT THE CRIME RATE HERE IN THE PHILIPPHINES WILL DECREASE. WHY DO WE NEED TO REINSTATE THE DEATH PENALTY? FIRST OF ALL MORALITY: Ultimately, the moral question surrounding capital punishment has less to do with whether those convicted of violent crime deserve to die than with whether state and governments deserve to kill those whom it has imprisoned. The legacy of racial apartheid, racial bias, and ethnic discrimination is unavoidably evident in the administration of capital punishment. Death sentences are imposed in criminal justice system that treats you better if you are rich and guilty than if you are poor and innocent. This is an immoral condition that makes rejecting the death penalty on moral grounds not only defensible but necessary for those who refuse to accept unequal or unjust administration of punishment. Moreover “An eye for an eye” does not mean vengeance, for the Almighty God himself said, vengeance is mine and by this he meant he would met justice in accordance with his mysterious way through the Ten Commandments from which morals laws were taken. ACCORDING TO ARTICLE 3 SECTION ONE NO one has the right to deprive another person of his life, or to degrade him or her to the status of an animal, or abuse and debase a person to the extent of destroying forever his or her dignity. In the Philippines where there is no clean and fair justice system, there is no doubt that if ever the Republic Act No. 7659 or…
