It is confidence in the men and women who administer the judicial system that is the true backbone of the rule of law. Time will one day heal the wound to that confidence that will be inflicted by today ' s decision. One thing, however, is certain. Although we may never know with complete certainty the identity of the winner of this year ' s Presidential election, the identity of the loser is perfectly clear. It is the Nation ' s confidence in the judge as an impartial guardian of the rule of law.” Through this statement it is obvious that Justice Stevens believes that the Federal Courts has no place in interfering on state voter laws and that the decision that was made by the majority of US Supreme Court Justices will negatively influence the perception of the Supreme Court. Justice Stevens is supported by Justice Breyer: “…the Court is not acting to vindicate a fundamental constitutional principle, such as the need to protect a basic human liberty. No other strong reason to act is present. Congressional statutes tend to obviate the need. And, above all, in this highly politicized matter, the appearance of a split decision runs the risk of undermining the public ' s confidence in the Court itself. That confidence is a public treasure. It has…

I agree with your point of view on the pros and cons on electing judges. Many people are unaware of how little they understand about the world and the law that applies to the society in order to prevent conflict. Electing judges has a retention election, which means the voters get to decide whether they want to keep or dismiss the judge, this ability can be beneficial and yet not because if the powers are in the hands of the voters, they need to choose base on an unbias opinion. Also, voters need to know the background information on the judges instead of randomly picking whoever they want to, base on their indifferent feelings.…

An impending issue currently involves the terms of the U.S. Supreme Court Justices. They are enjoying extended stays on the bench due to an increase in life expectancy. In fact, Justices are now serving an average of 26.1 years before retiring or death—twelve years longer than they did when the average span of a judge’s tenure was roughly fourteen years. Therefore, a proposal has been offered that addresses this concern. Under this proposal a judge would serve a term of ten years; after ten years the Justice would be eligible for re-appointment by the President upon approval of the Senate. This proposal has the benefit of limiting a Justice’s time on the bench, but that is outweighed by the proposal’s flaws. Therefore, a second proposal of…

In theory there should be no 'political' role for judges, but in practice there is. Ministers and their departments can break the law, MPs can be charged with breaking laws about election expenses and civil servants can be charged with handing over secrets about their political 'bosses'. A member of the judiciary has to decide whether they will be charged and, if so, what they will be charged with, and also has to preside over the trial and death with sentencing if they are found guilty.…
