If the court applies the doctrine of stare decisis in the case where the members of AOL that got their information mistakenly made public are filing a suit again AOL then the court would not dismiss the suit. AOL is arguing that its forum-selection member agreement states that Virginia courts are the place where member’s disputes will be tried. However, according to the Supreme Court a forum-selection is basically irrelevant if it contravenes with a strong public policy. Stare decisis means that the court must uphold prior decisions. And in the state of California, courts have declared in other cases that the AOL clause contravenes a strong public policy. Therefore, if the court applies stare decisis the suit will not be dismissed and the members of AOL can continue with their case against AOL in California.…

The problem in this case is L. J. Summers Company’s recently implemented cost reduction plan is causing degradation in the organization’s laissez-faire culture and has put the company at risk while challenging their competitive advantage. Furthermore, the inexperienced production manager (owner’s son, Blaine) is using his unearned power as an authoritarian leader to drive change. However, due to poor leader-follower relations, his management style is negatively influencing the synergies ultimately causing a decrease in group productivity and member satisfaction. In addition to causing turbulence between management and the employees, the cost reduction plan resulted in increasing waste and costs while putting productivity behind schedule. In order for L. J. Summers Company to increase efficiencies and reduce production costs, management should develop a plan that will lead to a re-organization of the company’s culture and create a new competitive advantage over their competition.…

Chapter 1 describes retailing, shows why it should be studied, and examines its special characteristics. We note the value of strategic planning and include a detailed review of Loblaw’s. We then present the retailing concept, along with the total retail experience, customer service, and relationship retailing. The focus and format of the text are detailed. Chapter 2 looks at the complexities of retailers’ relationships—with both customers and other channel members. We examine value and the value chain, customer relationships and channel relationships, the differences in relationship-building between goods and service retailers, the impact of technology on retailing relationships, and the interplay between ethical performance and relationships in retailing. The chapter ends with Appendix 2A, on planning for the unique aspects of service retailing. Chapter 3 shows the usefulness of strategic planning for all kinds of retailers. We focus on the planning process: situation analysis, objectives, identifying consumers, overall strategy, specific activities, control, and feedback. We also look at the controllable and uncontrollable parts of a retail strategy. Strategic planning is shown as a series of interrelated steps that are continuously reviewed. At the end of the chapter, Appendix 3A discusses the strategic implications of international retailing.…
