The Fair Labor Standards Act (FLSA) establishes minimum wage, overtime pay, and recordkeeping and child labor standards for both full time and part time workers in the United States. The FLSA establishes minimum wage and state and local government rules of employment. Exempt employees are employees who do not have to be paid overtime. The executive exemption is for those employees who manages an enterprise or direct the work of at least two other employees, with the authority to hire and fire employees. The administrative exemption applies an employee who assists in managing or running a business. The administrative position has to be one of importance that requires skill and training. The professional exemption applies to employees that have advanced degrees and whose work requires the exercise of judgment and discretion. The creative professional exemption applies to artists and persons involved in creative business. The computer professional exemption applies to computer hardware and software designers and programmers. There is also an exemption for outside sales employees that make over $100,000 a year who are part of one administrative task. The Department of Labor proposed significant changes to child labor laws in 2007. The Fair Labor Standards Act changed child labor and stated what jobs were not endangering to 14 to 18 year olds. This changed child labor significantly and was a direct result or injuries that were common for children in certain work environments. The modifications to the FLSA in substantially broadened the definitions of exempt employees. Prior to 2003 exemptions were determined on a case-by-case basis.
