Alexander Galvin's Dilemma
Point of View:

I chose the point of view of the Alexander Gavin, the Senior Project Manager of El Sahd Construction Company in Kuwait.

Statement of the Problem: Mr. Alexander Gavin's dilemma on whether to compromise his personal ethics/ principles or to accept the offer of Ajax Management to get the deal of the project.

Objective/s:

> To resolve Gavin's dilemma without prejudice to the company

Areas of Consideration:

1. El Sahd Construction Company is prosperous, with an excellent reputation in a timely and cost-effective way on major construction projects in the Middle East.
2. The Chairman and Chief Executive Officer is a well- known Kuwaiti and his direct boss is another American expatriate who is Senior Vice President for urban construction projects.
3. Alexander Gavin is the Senior Product Manager of El Sahd Construction Company in Kuwait. Two months ago, they put a bid to be the principal subcontractor on a project in Iran for $ 30 million When he was asked to go to Tehran on March 3rd and talk with Ajax manager of the major project, they told him that they can get the job provided that from $ 30 million of bid it will now become $ 33 million. The manager said that the additional $ 3 million will be divided to the Managing Director of their company in London, the manager himself, and $ 1 million to Alexander for him not to talk about their practice. According also to the manager, it is their way of doing business in their company.
4. Mr. Gavin was disturbed since he heard cases like these that that if the bidder fails to cooperate, physical harm might be part of the exchange.
5. Mr. Gavin is involved in “pay-offs” before but this is the first time where he was involved into taking a “cut” himself.

Alternative Courses of Action:

1. Alexander Galvin will accept the condition of the manager.
> Since Alexander mentioned that he had been involved in “pay-offs” before, then this should not be a problem. As the company

I think he should pay commission to the Middle East Ministry’s advisor. Like the advisor and the agent lawyer said it is common for these deals. The German and the Italian vendors did it. Also local agent’s most of clients which means Canadian companies did it before. It is a huge deal and he has to take it. Also advisor negotiated only $75,000 off the contract price. And I think the reason is he is interesting in his commission not about government’s budget. Therefore, he also wants to finish this deal. Matthew Kwong won’t be able to make this deal. Because the advisor is going to make an agreement with the other company which gives commission. This will be very bad for Matthew to lose his first attempt. He may lose his self confidence and also his reputation in front of his managers.…
