Advantages Of An Attorney For Uncontested Divorce
Four Reasons Both You and Your Spouse Need an Attorney for an Uncontested Divorce

In most cases, an uncontested divorce has the advantage of being cheaper than a divorce that is contested. However, this does not mean that attorneys should not be involved. There several reasons that you and your spouse should each, separately, use the services of an attorney, even when both of you are in agreement about the terms of your divorce settlement. The following are four reasons for this.

You may need an attorney to draw up the agreement
Depending upon what state you live in, the courts may require that the agreement be drawn up by an attorney. But since an attorney cannot represent both of your interests, it is best that a second attorney be employed

Assuming that the document is legal, your attorney can explain what it means to you, and how it will affect your life after the divorce is granted.

To negotiate on your behalf, if there is a disagreement
You may both think you are in agreement until you discover there was something you forgot about, or perhaps there was something about the law that you and your spouse did not understand. Having legal representation does not mean there will be an escalation in tension between you and your spouse. An attorney can simply help you with any legal hurdles, and make the process of an uncontested go more

Further proceedings would ensue regarding attorneys’ fees. This determination was based on the interpretation of the verbiage of the Decree in compliance with Arizona state law. Even the intentional omission of language regarding the termination of spousal maintenance upon the remarriage of the spouse in receipt of the maintenance does not serve as an “express” statement that the parties intended the spousal maintenance to continue after remarriage. Interpreting the lack of reference to termination upon remarriage in this situation requires a level of inference that does not fulfill the legal specification for an express statement. The court holds that if spouses seek to avoid the application of the Arizona state law regarding spousal maintenance termination upon remarriage, the intention to do so must be made unmistakably clear. Due to the fact that the decree does not expressly state that the spousal maintenance should continue after the remarriage of the wife, the court concludes that the obligation to pay is terminated upon the wife’s…

If the opposing party has Counsel, it is always my suggestion that they too should obtain counsel as the other party would be at an advantage of having legal representation to ensure their best interests are taken care of. Furthermore, an attorney would be able to assist in ensuring your case is properly filed and to ensure that all deadlines are met. If an individual does not meet necessary deadlines, their case can be thrown out for good. An attorney would also be beneficial once a settlement offer is presented as they can assist in negotiating on your behalf. I think that Gottman's "forumla" for divorce is very important and informative. There is all this talk about kind of laying it out as is in a relationship, almost dumping your problems on the partner and just hoping they know how to fix it. Or to have a big blowout fight and get all the issues out at once and then pick up the pieces. That's how I have always seen it done. However, Gottman points out the fact that these types of arguments are not effective. Arguing is good, it shows that people have beliefs and that couples are willing to hold true who they are as an individual, but arguing should not be a sport. They can't understand each other that way and it just becomes lose/lose situation. Gottman stress that couples should work together on issues and take them little by little. Understanding is…
