Residential Status and Incidence of Tax
According to Section 5 of the Income Tax Act the scope of total Income of an assessee depends on his residential status.On the basis of residential status assessee are classified under the following two categories: 1. Resident 2. Non-resident.
As per as resident individuals and Hindu Undivided Families are concerned, they can be further divided into two categories: 1. Ordinarily Resident 2. Not ordinarily Resident.
Residential Status of an Individual
The Conditions or rules for determining the residential status of an individual may be suitably classified in the following two categories: 1. Basic Conditions 2. Additional Conditions.

1. Basic Conditions:

(i) If the assessee resided in India in the Previous year for a period or periods amounting in all to 182 days or more. It is not necessary that the assessee should stay in India continuously or at one place only. (ii) If the assessee resides in India for a period or periods amounting in all to 365 days or more within the four years immediately preceding the previous year and he resides in India for 60 days or more in the previous year.

Exceptions:
In the following cases, stay of an assessee in India [with reference to condition (ii) mentioned above] during the previous year for 182 days will be necessary in place of 60 days:

(i) An Indian citizen who leaves India in any previous year as a member of the crew of an Indian ship. (ii) An Indian citizen who leaves India in any previous year for the purpose of employment. (iii) Person of Indian origin or a citizen of India who resides outside India comes on a visit to India in any previous year.

2. Additional Conditions:

(i) If the assessee has been resident in India in at least 2 out of 10 year immediately preceding the previous year, and (ii) If the assessee has, during the seven years immediately preceding the previous year, been in

    Instructions for filling out Income Tax Return FORM SARAL-II ITR-1 These instructions are guidelines for filling the particulars in this Return Form. In case of any doubt, please refer to relevant provisions of the Income-tax Act, 1961 and the Income-tax Rules, 1962. Assessment Year for which this Return Form is applicable This Return Form is applicable for assessment year 2010-2011 only, i.e., it relates to income earned in Financial Year 2009-10. Further, in a case where the income of another person like spouse, minor child, etc. is to be clubbed with the income of the assessee, this Return Form can be used only if the income being clubbed falls into the above income categories. Who cannot use this Return Form This Return Form should not be used by an individual whose total income for the assessment year 2010-11 includes,(a) Income from more than one house property; or (b) Income from Winnings from lottery or income from Race horses; or (c) Income under the head “Capital Gains”, which are not exempt from tax, e.g., short-term capital gains or long-term capital gains from sale of house, plot, etc.; or (d) Income from agriculture in excess of Rs. 5,000; or (e) Income from Business or Profession. Annexure-less Return Form No document (including TDS certificate) should be attached to this Return Form. All such documents enclosed with this Return Form will be detached and returned to the person filing the return.     73rd Amendment Act of Indian Constitution related to Panchayti Raj System is not applicable to state of J&K. The Panchayats in J&K are still based on the J&K Panchayati Raj Act 1989. The act provides a three tier structure of Panchayati Raj System in J&K consisting of Halqa Panchayats, Block Development Councils and District Development Boards at village, block and district levels respectively. Gram (village) Panchayat is known as Halqa Panchayat to be established in every village (Halqa).
