Tax File Memorandum #1
From:
Subject: Peaceful Pastures Funeral Home, Inc.
A tax issue that has been brought to me for assistance regarding an audit notice from the IRS for Peaceful Inc.
Facts: Peaceful provides a prepaid program that allows customers to pay in advance for their goods and services that will be provided to them on their funeral day. Under their contract, the payments are refundable at the contract purchaser’s request any time until the goods and services are provided to them. Peaceful is operating as an accrual basis taxpayer and has included these payments and income for the year the funeral service is provided.
Issue: Is the money paid in advanced to Peaceful under their prepaid program subject to tax the year it is received?
Conclusion: Prepaid amounts received by Peaceful Pastures Funeral Home, Inc. under the funeral’s prepaid program are includable in income only upon the provision of the funeral goods and services.
Analysis: Under the accrual method, income is to be included for the taxable year when all events have occurred that fix the right to receive the income and the amount of the income can be determined with reasonable accuracy. Secs.1.446-1(c)(1)(ii), 1.451- 1(a), Income Tax Regs. Typically, all events that fix the right to receive income have occurred upon the earliest of the following to take place: The income is (1) actually or constructively received; (2) due; or (3) earned by performance. As settled under the Supreme Court in Commissioner v. Indianapolis Power & Light Co.1990, a complete dominion test was preformed to identify the payments over which the taxpayer has such control as to render them income. Peaceful offers its customers the option for advanced payments and guaranteed a full refund under its contract. In relation to Johnson v. Commissioner 1997, advanced payments are then nontaxable the year of receipts and Peaceful’s right to retain these payments is contingent upon events outside its control.

Before our tour to All Souls Mortuary & Cemetery, I envisioned this location to be a smaller, old fashion, catholic location without modern technology, but I was wrong. In reality, All Souls was beautiful, modern with a touch of vintage and it had a “homey” feeling, as well. Moreover, Steve Allen, the mortuary manager, was such a friendly, funny and knowledgeable individual with many years in the funeral profession. Fortunately, I was part of the group he guided and Mr. Allen brought up topics that are discussed during class, which made believe that he was up to date with current funeral trends. While showing us the visitation room with a decedent, Mr. Allen stood in front of the deceased so she can have her privacy, which was very ethical of him. Also, during the tour of the preparation room, the staff placed white sheets on top of all the decedents due to their belief of reverence for the dead. “The basic ethic for the funeral service profession can be referred to as reverence for the dead” (Klicker, p.9).…

Throughout history, people's attitudes towards death have changed. From accepting to death as a natural part of life, to defying the inevitable, the one fact that remains is that we will die. After visiting Cruikshank’s Funeral Home I now have accepted this fact and pondered what will happen for those close to me when I die. A funeral is a time for valuing the life of the deceased, and I now see the value in allowing those within my life to host a service where they can receive closure, and remember what I have brought to the world. This paper will examine the experience I had at Cruikshank’s funeral home and provide insight as to how my attitudes towards funerals has changed as a result.…

It is never a good feeling or experience when one hears about funerals, especially if the person being laid to rest is a loved one or a close acquaintance. In some cases, funerals can be a unique experience despite the somber atmosphere of saying goodbye and recalling the good moments with the deceased. There are funerals followed by a military or crowd procession or a necrological service or eulogy, and a few would only be an intimate gathering of friends and relatives to say goodbye to the recently deceased. If the deceased has a position in government or a known personality, their funerals are often anticipated to see the people who had attended and what kind of honors did he or she receive. Funeral plans and the chance to pick what type of funeral can even be done in advance. While many argue that funerals are now becoming old-fashioned, many families still prepare and pay hefty amounts for funerals considering their religious importance and the fact preparing lavish or special funerals for love ones shows how much the person meant for the family or group.…

Abstract: While as the economy starts to rebound, the centuries-old industry is learning to embrace new technology as a way to keep it from, well, dying., after-death products and services, by contrast, must edge along an emotionally touchy route to reach customers because funeral homes are moving away from the "cookie-cutter funeral" and starting to personalize the services and offer new features., lower-cost funeral homes and funeral stores are fighting for their share of the national death-care market by responding to the demands of the budget-conscious, time-pressed baby boom generation., and wen customers come to a funeral home, they first meet with a funeral director to talk about the person who died. The new marketing of funeral services the funeral director and the next of kin spend a couple of hours compiling stories and details about the life that person lived.…
