Summary of case Shirley Smith is a 58 year old female employee that was a current cancer patient and over the past few years has been performing mediocre work. The issues that Rob Peterson and the company faces, if they should fire Ms. Smith, is that cancer is covered under the American’s with Disability Act. She is a female which makes her fall under the Title VII of the Civil Rights Act and the fact that she is 58 years of age so she is covered under the Age Discrimination in Employment Act. (Popejoy, 2006) Emily Lessiker was one of three final candidates for an Auditor 1 position and just informed Rob Peterson that if she is chosen for the job she couldn’t start until six months later as she has leukemia and is undergoing a bone marrow transplant. The doctors informed her that her chances of recovery are excellent but will need four to five months of recovery time. This puts Rob Peterson in a predicament since she volunteered this information, but it could come back to him that his decision not to hire was based on her condition. (Popejoy, 2006)

Identify the implications of the employment process (termination) described, which may create a legal liability
Termination process Shirley Smith has had three years of poor performance reviews of which during the last review she was required to participate in additional training in order to improve her performance, which she completed. (Popejoy, 2006) The reading doesn’t indicate if her performance had improved although it did state she was not capable of handling increased responsibilities. He should plan on putting her on a performance plan before firing her that way it will protect the company and allow Shirley to show her manager the chance that she can grow and improve on various areas. If he/she doesn’t make a comeback in performance after being put on notice, they must replace that person. (How to

    1. Legal Issues: Linda Dillon sued her former employer, Champion Jogbra, claiming that it breached an implied contract when it terminated her employment without following the company’s progressive discipline policy as stated in the company handbook. She also argues that the trial court’s summary judgment on her claim of promissory estoppels was incorrect. Champion claimed that Dillon was an at-will employee, and thus could be terminated at any time, and that nothing in the employee handbook created any contract rights. To support this claim, Champion pointed to the prominent disclaimer on page one of the handbook, which stated:…

Message 1: In regards to the situation at our Anderson location where the GM terminated two employees without providing a reason for discharge, the company may be at risk for a wrongful termination discharge lawsuit. The risk will increase if the GM is not able to provide sufficient documentation or other evidence of the appropriate reason for his decision. The GM choose to exercise the definition of at-will employment by “viewing the employment relationship as one to where there is no contractual obligation to remain in the relationship; either party may terminate the relationship at any time, for any reason, as long as the reason is not prohibited by law, such as for discriminatory purposes” (Bennett-Alexander & Hartman, 2007, p. 25). To minimize risk, we will need to partner with the GM to understand how he determined what two candidates would be selected for termination and how that information was communicated to the employee.…

A non-profit Pennsylvania corporation located in New Orleans, LA named Resources for Human Development, Inc. (RHD) has a lawsuit on their hands after firing employee, Lisa Harrison, because of her obesity. The U.S Equal Employment Opportunity Commission (EEOC) filed suit against the company for violating the rights stated in the Americans with Disabilities Act (ADA). The ADA law prohibits discrimination based on disability. Harrison began working for RHD in 1999 and remained there until September of 2007 when she was let go because of her severe obesity. RHD claimed Harrison was limited in a number of major life activities, including walking. However, according to the lawsuit, her obesity did not interfere with the fulfillment of her job description and her ability to perform the essential functions of her job. Unfortunately, Harrison passed away before the EEOC filed suit.…

Various factors exist when considering the justification for employment terminations. Employers can simply invoke their right to terminate employees based on the at-will employment doctrine. However, carefully examining the legal repercussions prior to capitalizing on at-will terminations is recommended. Another significant reason for terminations are behavioral-related offenses by employees, instigating due cause.…
