Use of Facilities by Religious Groups 1. Yes, I believe the Bible club has legitimate grounds to file suit for use of school facilities. Principal Gayle Dixon’s decision to deny the club use is based on her interpretation of the club’s charter to be discriminatory and not necessarily the law’s or districts. 2. No, I would say principal Dixon is not justified to deny use of school facilities because she is making the judgment based her beliefs and not the eye of the law’s. 3. Yes, the Bible club has the right to specify that only Christians may be club officers based on the fact that the Bible club members all agree or vote for the standards of the charter for the club. 4. If I was the principal of this school and I questioned whether this part of the charter was legal to enforce I would consult the district office or the school/district legal counsel to ask if it was appropriate to allow the club use of our facilities based on that part of their charter. I would take the decision out of my hands to what was legally appropriate. 5. Based on my answers above, I believe a court would rule for the club to have equal access to our facilities based on the fact that as the school, we have no rights to tell the Bible club how to operate their club. 6. As an administrator, it would be up to me to ultimately allow or refuse access to the club unless higher authority permission was need (i.e. District approval). If I denied the club access to our facilities based upon my personal beliefs or interpretations, not only would it open myself, the school, and the district up to legal action, it could cost me my position as principal of the school.

Search on School’s Parking Lot

1. I am going to say there was not enough of a reasonable basis to initiate a thorough search based on just readmittance slips being found in the student’s purse. As Essex (2008) points out, to me readmittance slips

    A requirement that they must fulfill, as members of the church is they must eschewal from public schools since what they teach in public schools aren’t the same values taught in the church. Calbert and his wife have been homeschooling their two children and have requested to be provided with mental health counseling at home for their two children. Their application was denied due to their children not being part of a public school. Their denial of application violated the Establishment Clause of the First Amendment. It is violating the Establishment Clause of the First Amendment since the government is prohibiting the free exercise of their religion. They are expressing their religion and standing within their values by keeping there two children in homeschool. In Thomas v. Review Board of Indiana Employment Security Division (1981) Eddie Thomas who was a Jehovah’s quit his job on religious grounds and he filed for unemployment. He was able to receive unemployment benefits since his new job duties violated his religious beliefs. If Eddie Thomas was able to receive benefits regardless of his religious beliefs, then Calbert’s two children should be able to receive mental health counseling. Benefits were not denied to Mr. Thomas nor should they be denied to these two children. Although they do not attend a public school, they are still within the district without actually being inside a building. Their homeschooling is recognized from the public school…

    In my ruling, the illegal glorification of the drug culture “Bong hits for Jesus”. I feel the school had made a bad judgment call about having the banner. I feel it is not an attack on the saying “Bong hits for Jesus”. I feel that this is an attack on the student’s first amendment rights, just because the sign had something to do with marijuana. The school has an anti- drug program. I believe a non- disruptive pin, shirt, banner, etc. should not be taking from a student, for the shear fact that they oppose the anti-drug programs that the school offers. It is an attack on their first amendments rights. It was a 15-foot joke. The school dose has the right to not tolerate an interruption of a school sponsored anti-drug event. But this was not this kind of an event and the banner was not placed on school grounds. The banner was placed across the street from the school in a public open forum. One cannot be punished for holding of a banner not on school property. I feel that the principal was wrong to hastily take the banner down in the heat of the moment, but feel she should not pay punitive damages, for the banner was not worth much. Though the pride of the student’s who put the banner up was hurt a little I feel they should not be punished for expressing their first amendment rights, which they demonstrated non-violently, very conformed manner, and not on school property.…
