Unit 21: Aspects of Contract and Business Law

Introduction

In this task I am going to explain the law with respect to consumer protection in given situations. In this task I am going to investigate statutory consumer protection by taking part in a legal meeting. I will represent Jordan Smith who wants to make 2 complaints; one to the manager of Comfyfloors and the other to Trevor Taylor. In order to represent Jordan Smith I will be required to read and base my responses on the enclosed case study (Appendix 1). In order to meet this criteria I will prepare detailed notes for my meeting for both complaints:

Jordan v Comfyfloors

I will examine Jordan and Comfyfloors’ rights under the Sale of Goods Act 1979 by:

• Identify whether a contract for the sale of goods has been formed

• Explain how Jordan’s rights may have been affected as he bought the carpet having seen a sample in the showroom

• Explain all technical terms used and relating them to sections of the Sale of Goods Act 1979

Jordan v Trevor Taylor

I will examine Jordan and Trevor Taylor’s rights under the Supply of Goods and Services Act 1982 by:

• Identify whether a contract has been formed

• Identify and describe the implied terms relevant in this situation

• Explain whether there has been a breach of implied terms

• Explain all technical terms used and relate them to sections of the Supply of Goods and Services Act 1892
