Unit one: Principles of personal responsibilities and working in a business environment

Section 1: Know the employment rights and responsibilities of the employee and employer

1. Identify four main points that would be included in a contract of employment. If possible, use an example contract to support your answer (feel free to obscure any confidential information).

Things that has to be included are
1. Employer’s name
2. Employee Name
3. Date of commencement of employment
4. Employee position
5. Salary
6. Main place of work

For example I have recently received the offer from Royal mail for the temporary contract position. Following are the sort summary:

Working Location: Employee must be aware that by attaining this position, the employee will also agree to work in Rochester Royal mail centre. There may be time the employee must be flexible to work in other reasonable locations in other Medway town as and when Business needs arise.

Abort from the above detail, there was probation period, termination condition and notice period as well.

2. Legislation:

a) List three key points of legislation that affect employers in a business environment.

i. Health & Safety
ii. Data Protection
iii. Pay and Pensions

b) List three key points of legislation that affect employees in a business environment.

i. Pension
ii. Pay
iii. Employment rights and responsibilities

3. Identify a range of places where a person can find information on employment rights and responsibilities. You should identify at least two internal and two external sources of information.

a) Internal information from
i. Line managers
ii. Informed Colleagues
iii. Staff association representatives
iv. Personnel specialists

b) External information from
i. Libraries
ii. Legal professionals
iii. Citizen advice bureau
iv. Web pages for example; Direct gov.

4. Describe how representative bodies can support employees.

A trade union representative is a union member who represents and gives advice to colleagues when they have problems at work. They can support an employee by

i. Discussing any concerns employees may have regarding their employer ii. They can accompany you to disciplinary or grievance hearings with management. iii. Develop the best possible health and safety procedures with your employer iv. Represent you in negotiations over your pay and terms and conditions of employment this is known as ‘collective bargaining’. v. Meet with your employer to find solutions to workplace issues

5. Identify employer and employee responsibilities for equality and diversity in a business environment. You should give at least two employer responsibilities and two employee responsibilities. If possible, provide relevant equality and diversity procedures from your workplace (or place of study) to support your answer. These documents should be annotated to highlight the relevant sections.

Employer responsibilities:
i. Abiding by the relevant areas of legislation appropriate to the workplace. a. Disability
b. Discrimination
c. Employment
d. Equality
e. Sex Discrimination
f. Equal Pay

ii. Investigating any issues that arise in relation to equality and diversity.

iii. Treating colleagues with respect

Employee responsibilities:
i. Following company policies relating to equality and diversity ii. Treating colleagues with respect
iii. Reporting issue

6. Explain the benefits of making sure equality and diversity procedures are followed in a business environment. Your answer should include one benefit for the employer, one benefit for the employee and one benefit for the overall organisation.
