Abstract
        Write a 350-word synopsis for each scenario in which you answer the following statements:

            o What tort actions do you see?
            o Who are the potential plaintiffs
            o Who are the potential defendants and why you see each one as a defendant
            o The elements of the tort claim that constitute the plaintiff’s claim
            o Any defenses you think defendants might assert
            o How you think the claim will be resolved, stating legal reasons for your answer

      Scenario - 1 The Football Game
      During the scenario where the ball ending up into the stands, injuring a fan is an accident unintentional and I don’t think that there would be any liability. However, the fight or the shoving of Malik by Daniel can appear as an assault and battery. As far as the rail at the stadium giving way, it could be trouble for the owners of the stadium with Malik’s injuries.
          I also see the incident as Daniel was leaving the stadium as Malik was committing a “tort of outrage” by pulling an unloaded gun, which is something you should never do unless you intend to use. The intentional battery on Malik’s life is something that Daniel will have to deal with as soon as he wakes out of the Diabetic coma he is in due to the accidental regular soft drink switch at the soda stand, this could been seen as an unintentional tort..
          The first plaintiff I would think would be Malik, because of being shoved by Daniel and loosing his teeth. With the rail being defective Malik could also be a plaintiff against the stadium. I also think that Daniel as a plaintiff could sue his boss and company for firing him under what he thought was giving beer to a minor and not knowing or trying to find out what happened instead made a knee jerk decision to fire him.
