Abstract
The State of Confusion enacted a decision requiring all trucks and towing trailers that use Confusion highways will be required have in place the B-type truck hitch. The B-type hitch is manufacture by an entity contained by the state of Confusion. This part cannot be found anywhere else. One of these companies had a problem with this new item required by trucks. Tanya Trucker had a trucking company with the state of Denial. In order to pass through the state of Confusion her trucks would be required to have the hitch mounted for safety in order to drive through state of Confusion, or drive around it. This would cause Tanya’s Trucking company to take along route and would increase cost for having item delivered to its destination. This could cause a loss of business to her. Tanya had issues with this due to the increase in cost that she has incurred for the addition of the hitch. She definitely not happy about buying the hitch and incurring additional expenses. Therefore, she intends to file a suit against the state of Confusion to overturn the statues set by the state of Confusion.
What court will have jurisdiction on Tanya’s Law Suit?
I believe that she would be able to file her case in the state court in the state of Denial but if the state of Confusion feel that she would it would not be a fair trial then the Federal Courts would be her best option. The Federal District Court that will have jurisdiction over Tanya Trucker’s suit, because it has to do with the Interstate Commerce. Cheese man (2010) states, “A case may be brought in federal court if there is diversity of citizenship”. I would think depending on the severity the Federal District Court may also have jurisdiction over array of citizenship lawsuits.
