Part A
Question 1 – Negligence Problem Question
You will be required to discuss the potential liability arising from a road accident. You should be prepared to discuss and apply the principles relating to duty of care, breach of duty and causation and remoteness of damage. You will also need to consider the legal position when injuries are exacerbated by third party intervention and in particular consider the application of principles relating to novus actus interveniens.
Part B
Question 2 – Negligence: Economic Loss
You should be prepared to answer an essay question on economic loss. You will be expected to demonstrate knowledge and understanding of the development of liability for negligent misstatements and the interpretation of ‘special relationships’. You should also be prepared to evaluate the relevance of policy factors to the development of this area and the manner in which the courts have prevented indeterminate liability from arising.
Question 3 – Negligence: Medical Negligence
This question will take the form of a problem question on medical negligence. You will need to discuss the potential liability of an NHS hospital. You should be prepared to discuss and apply principles relating to duty of care, breach of duty and causation and remoteness in the context of medical negligence. You should pay particular attention to case law surrounding loss of chance, informed consent and failure to warn, junior doctors and the appropriate level of supervision. Your answer should discuss and apply relevant case law.
Question 4 - Negligence: Psychiatric Injury
