1.)   Do you agree or disagree with the Becknell v. Board of Education decision? (pages 1324-26) Explain. In the case of Becknell v. Board of Education decision I agree 100%. This is a clear cut case of discrimination due to the fact that not only was she qualified the court could not find a valid reason as to why this would be a male only position. I remember when I had Mrs. Strong (yes that was her real name) as a principal in elementary school and all the kids were relieved that she was retiring. I was in the 5th grade. She was a very strict disciplinarian and the students knew it and did not want to try her. Her replacement was 6'7 Mr. Borger. He was extremely intimidating but ended up being the biggest softy and when or if he ever had to discipline anyone it was apparent that it hurt him just as much if, not more to carry out the punishment. The point is, it doesn't matter your gender. Everyone has their leadership style. If you are qualified for the job how you carry out your daily activities as long as it is within the rules and regulations should be up to you. Question 2

2.) Tom, age 38, was fired from his job as a skateboard salesperson because he was “too old”. Does Tom have a claim (lawsuit) under the Age Discrimination in Employment Act (ADEA)? Why or why not. Explain. Unfortunately, Tom does not have a case due to the fact that Tom does not qualify for the Age Discrimination in Employment Act of 1967 or the Age Discrimination Act of 1975. These programs are for individuals 40 and older and applying for federally funded jobs. Furthermore, the job that he was holding may have been difficult for him to relate to the clientele. We really should not assume but, with little information on Tom it is very difficult to paint the picture of how much information a 38 yr old has on skateboarding unless he was Tony Hawk (which is 42)or someone like him.
