Post Tender Negotiation
Post tender negotiation simply means the negotiation that goes after the tender is submitted by the bidder and before awarding the contract, it can be regarding the price or other aspects as well. In most cases it is not permitted to negotiate after tenders, but many purchasing professionals debate on if post tender negotiations can be desirable (Sollish et al, 2011). The UK National Health System (NHS) does not permit post tender negotiations under the Official Journal of the European Community (OJEC) tendering process (NHS, 2010).
As it is mentioned, many procurement professionals still debate on the allowance of post tender negotiations or not. This discussion will include points both supporting NHS choice of permitting post tender negotiations, and disagreeing on NHS policy. The Charted Institute of Purchasing & Supply (CIPS) mentions in their knowledge summary about tendering and post tender negotiations, the summary supports the idea of involving negotiations in post tenders if used professionally and ethically, as it secures value for money, and there should be a responsibility from the purchasing professional if a particular contract requires post tender negotiation (CIPS, n.a.). While Sollish et al (2011) claims that bidders realize that there is no post tender negotiations, it is more likely that they present the best price in the original tender. CIPS (n.a.) clarifies one of reasons to allow post tender negotiations improving value obtained, by claiming that detailed discussion before awarding the contract should discuss bid clarification usually with number of suppliers if the bid is too low or too high, the discussion can include specification or lead time for example. As most sources and professional argue that price negotiations post tender is mostly not permitted, like the case of NHS.
We understand from the points that post tender negotiations can be acceptable depeding on the nature of the contract, and that is decided by the procurement

    Only one of which is actually relevant to the legal action brought on by the City. The case of the Queen in right of Ontario et al. v. Ron Engineering in the Supreme Court of Canada in 1981, established that the tendering process consists of two contracts, Contract A and Contract B [1]. Contract A is a tendering agreement and while the Contract B is the actual contract to do work [2]. In this case, the City of Waterloo's call for tenders and the following bid by SoftX Programmers constitutes Contract A between the two parties. The heading in itself tells us that the government is doing more and more business by contract and as a result contractors who are lobbying for government business have become more aware of their rights to file disputes when it involves a loss of potential business. Because of this increase in disputes, the government must have a method of terminating contracts without suffering the financial liabilities that could result in millions and millions of dollars going to incomplete contracts and rebids to acquire a contractor for completion of unfinished contracts. This method of termination is known as a Default Clause which will be covered later in this paper. First we will look at a case that involves a contract dispute. The GAO file number: B-215789 which involves J.C. Hester Company, Inc who was awarded contract number: F34650-81-C-0158 with the Department of the Air Force. My reason for choosing this dispute case was because it requires that the individual look at all aspects of the case in reference to Disputes. Usually dispute cases depend on more than one aspect of the FAR. This case shows that not only the contractor but the contracting officer should pay strict attention to the reasons for the dispute. In this case knowledge of the Bids Protest Process area of the FAR is also required to determine if the recommendation by the Comptroller General was indeed valid and fair.…
