HAZLI AND SHAHREEN

Issues
1) The second customer that would like to buy the vase.
2) He willing to pay RM400 for it.
3) Hazli replied that he would accept RM450. On his journey home, Shahreen realized that RM450 is a good price. After that, he immediately wrote to Hazli to buy the vase.
4) Whether Hazli, the dealer of the vase, is accept or not the agreement by Shahreen.

Relevant Law In this case, the relevant law is the counter offer. At first, Shahreen would like to buy it for RM400 but Hazli did not accept for that price. He would accept for RM450 price. On journey home, Shahreen agree with the price and wrote the letter to Hazli.
In this case based on case : Hyde v Wrench ( 1940) 3 Bench 334.

Defendant offered to sell his farm to the plaintiff for 1, 000
June 8
Plaintif made a counter offer of 950 but defendant refused to sell.
June 27
Plaintiff wrote again offering to pay 1,000. The defendant refused and the plaintif sued for specific performance.

Conclusion
Shahreen make a counter offer.

Issues
1) The first customer that would like to buy the vase.
2) Mail walked past the shop and would like to have it. Unfortunately, he was late for an important meeting.
3) As soon his meeting was finished, he wrote the letter and agreeing to buy the vase.
4) Whether Hazli, the dealer of the vase, is accept or not to the agreement by Mail.

Relevant issues
In this case, the relevant law is the display of goods in and invitation to treat. Hazli put the vase to be display of goods. This case, based on case :
Fisher v.Bell ( 1961) 1 QB 394 CA )
Fisher was offering for a flick-knife. He put the knife for display of goods and invitation to treat.
According to the ordinary law of contract the display of an article with a price on it a shop window is merely an invitation to treat.
