In 2010, the Department of Justice published updated regulations under the Americans with Disabilities Act (ADA).   These regulations adopted the 2010 Standards for Accessible Design (2010 Standards), which, for the first time, contain specific accessibility requirements for a number of types of recreational facilities, including swimming pools, wading pools, and spas.   As I currently work in a hotel I am constantly working around all of the fore mentioned facilities.   More over as I am Director of Security for the hotel I am charged with all safety compliance as well this includes ensuring that all facilities are ADA compliant so that all of our guests have a great uninterrupted stay in the hotel.
In January 2012, the Department issued guidance titled “ADA 2010 Revised Requirements: Accessible Pools—Accessible Means of Entry and Exit” to assist entities covered by Title III of the ADA, such as hotels and motels, health clubs, recreation centers, public country clubs, and other businesses that have swimming pools, wading pools, and spas, in understanding how the new requirements apply to them.   (1)
This revised requirement mandates that all or at least the main pools in these facilities to install and maintain a lift to aid all person needing assistance in and out of the pool.   Previously all that was required was to have an area that eased the entry and exit of the pool. (2)
My comment to this regulation would be that it is very beneficial to all persons with disabilities.   Giving these people the opportunity to sit in a pool, instead of sitting outside watching and wishing or feeling as if they are a burden when people attempt to include them from the side they will be able to be included now.   (3)
Originally the regulation required that the accommodations must be made and completed by March 15, 2012.   However, the Department extended the deadline to January 31, 2013. This is good to some respect because it give many... [continues]
