Hill vs. Colorado and the Interpretation of the First Amendment

In recent years we have seen an increase in constitutional issues over the First Amendment which allow the practice of freedom of speech. Excellent situations have arisen recently such as the right to protest at funerals or individuals going to conversational health clinics. In particular, the issue over protesting at military funeral that were a result of sacrifice done at war time and women entering abortion clinics have become a national sensitive subject and an nightmare in determination certain rights. These protests have introduced a situation where there is a fine line between the right to an individual privacy and the right of freedom of speech. Recently we have seen states apply laws that protect the individuals privacy by making protestors and activist follow obligations in exercising their right. Most of these laws follow the guideline setting a minimum distance from certain establishments and personnel without permission.
In the past years the Supreme Court has been busy in providing guidance in determining interpretation of the first amendment and ensuring that an individual's personnel privacy is not being fringed upon. One such case is Hill vs. Colorado where the state of Colorado issued a law that prevented individuals from protesting or rallying approach any personnel entering health care facilities within 100 ft , unless they were given permission. Leilia Hill and others who serve as sidewalk counselors , which were offering alternative options to abortion, sought that the state law was a violation to her constitutional freedom of speech and press that falls under the first amendment. With this situation it established rather the law requiring speakers to remain out 100 ft from any medical facility and not approach any personnel entering or exiting the facility... [continues]
