GROUP ASSIGNMENT

QUESTION & GUIDELINES

OBJECTIVE:

The aim of this assignment is to assess students’ understanding on Malaysian law and ability to apply the basic principles of contracts.

GUIDELINES

1. This assignment contributes thirty percent (30%) of the coursework marks.

2. It MUST BE in essay form (not point or bullet form except if using table).

3. Use A4 size paper and computer typewritten (word document):

a. Font : Arial/Times New Roman
b. Font size : 12
c. Spacing : 1.5
d. Justified with the following margins
- Top : 1”
- Bottom : 1”
- Left : 1.25”
- Right : 1.25”

4. Minimum pages is Twenty (20) [not included content, bibliography/references, agreements, pictures and appendixes] and the maximum pages is Forty (40).

5. It MUST have Introduction, Conclusion & References/Bibliography (any format). Picture, table, graph, cartoon, color paper, etc may be use or insert to make your assignment interesting.

6. The cover page MUST BE in accordance with Appendix 1 (as attached below). Color paper may be used as cover.

7. Submit in binding form (at least ring/comb binding, NOT staples).

8. Directly copying other people’s works and/or cheating will also NOT be awarded any mark. 9. The last date of submission hardcopy is on or before 22/12/2014 (week 10) before 5:00p.m. A softcopy MUST BE submitted (in CD-attach together with the hardcopy) as back up or proof of submission.

10. No marks will be awarded for late submission and no extension of time will be given.

INSTRUCTIONS:

1. Form a group which members as announced and REGISTER the group members’ name and particulars to the Class Representative assigned. (Week 1)

2. For Introduction, discuss on Definitions and Functions of Law. (Week 2)

3. Next, discuss and distinguish the followings: (Week 3)

(a) Civil and Criminal Law; and
(b) Legislation and Subsidiary Legislation.

4. Find ten (10) samples of Legislation. Photocopy or print only the front page (not the whole statute). (Week 4)
5. Discuss on the Orang Asli Customary Law. (Week 4)

6. Analyze the news below and identify in which court the cases were tried. Discuss also about the court and your reason(s). (Week 5) News 1

MALACCA: A 26-year-old woman’s offences involving two vehicles used by government officers drove her straight into the arms of the law when she was charged…. for stealing the cars … If convicted, she could face a jail sentence of not less than one year and up to seven years, a fine or both.

Robber saved from jail sentence by mum’s tearful plea
KUALA LUMPUR: A mother’s tearful plea and a wife’s non-stop sobbing saved a part-time caterer from a jail sentence after he admitted to being a member of a robbery gang. Mohd Kamal Harman, 30, pleaded guilty for his part in robbing engineer Dzulfadly Johare, 28 of a mobile phone, RM250 and US$351 (about RM1,228) at a car park of Menara Orkid in Bandar Baru Sentul here at about 6pm on Dec 30, 2007. 7. Discuss on the Martial Court and the Industrial Court in Malaysia. (Week 6)

8. Explain the followings: (Week 7)

(i) Differences between Invitation to treat and Proposal;
(ii) Differences between Cross-offer and Counter-offer.

9. Discuss on the concept of ‘Caveat Emptor’. (Week 7)

10. Each group must find ONE (1) original agreements/contracts. Each group must have different agreements. No similarity or redundancy is allowed. Samples form the internet or blank documents are also NOT allowed.

11. Once you have the agreement, photocopy or scan the said agreement (if the name of the parties in the agreement is confidential, you can liquid/cancel it and write any fictitious name) and return the original set to the owner. This agreement MUST BE attached at the back of this assignment as Appendix.

12. Read, analyze and understand the selected agreement and then answer the following questions.

Explain and identify from the said agreement the following: (Week 8)
(i) Promisor & Promisee;
(ii) Consideration;
(iii) Capacity of the parties;
(iv Three (3) Duties of the Promisor; and
(v) Three (3) Duties of the Promisee

13. Conclude your paper by explaining the Advantages of Learning Commercial Law and the Benefit that you have gained from this assignment. (Week 9)

14. Marks also will be given based on well organized and structured answer, good introduction and conclusion, creativity, and compliance with the format.
