This is criminal case no.145040 which involves Ceferino Jose y Gonzales as the complainant and filed a case against P01 Francisco Magbunga y Ilagan as the accused for the commision of the crime of Grave Threaths. The accused was said willfully, unlawfully and feloniously threaten to inflict bodily harm upon the person of Ceferino Jose y Gonzales by then and there pointing a gun at him,a wrong amounting to a crime, thereby subjecting the said complainant into fear,fright and danger. The complainant filed the accused violating section 7 rule 12 Revised Rules of criminal procedure.

Investigation disclosed that on or about 4:30 pm,19 October 2008, along Fatima drive, Gloria 3 Subd. Brgy. Culiat, Quezon city, while Ceferino Jose y Gonzales and Nestor Corpuz y Serraon were parking the delivery vans of their boss, P01 Francisco Magbunga y Ilagan suddenly appeared and were shouting invectives at them, but they did not take notice of the latter who then went away. Upon coming back, P01 Francisco Magbunga y Ilagan, who was now armed with a handgun, pointed it at Ceferino Jose y Gonzales while still shouting invectives at them, but still managed to evade the suspect. Ceferino Jose y Gonzales and Nestor Corpuz y Serraon told their boss about the incident, who then lost no time in seeking help from P03 Reynaldo Angeles and P03 Raul Flores. P01 Francisco Magbunga y Ilagan was informed of his constitutional right to remain silent and to have a competent and independent counsel of his own choice. He was then brought to the police station of Quezon city for further investigation and proper disposition of the incident.

When the case was called for arraignment, accused P01 Francisco Magbunga y Ilagan is present in Court. Accused was duly assisted by Counsel-de-Oficio, Atty.
