Petition under Fundamental Rights of Citizens vested in Constitution of Islamic Republic of Pakistan 1973
It is submitted that on Inter District Transfer of staff in Education Department especially female from one District to other due to marriage etc. on wed lock basis. Seniority of parent District is snatched and such staff is placed at the bottom of seniority list of their cadre in the present District. Which is gesture of ill will instead of good-will, therefore this wedlock proves a steel lock as the result of the destined loss of seniority for professional development and job satisfaction as well.
Our’ is polarized. Along with others an element, gender discrimination is a visible part of prevailing culture at gross root level, therefore, ladies are facing various exploitations.
One of the avowed constitutional objectives of Islamic Republic of Pakistan is to enable citizens to order their lives in individual & collective spheres in accordance with the teachings of Islam and religious prerequisites. The Constitution of the Islamic Republic of Pakistan according mandates that all the existing laws shall be brought in conformity with the conjunctions of Islam. Equity is one of the basic and foremost principles guaranteed by the Constitution.
Women are facing a steed clear of trouble by law. The heinous rule placing the civil employee at the bottom of seniority resultant to Inter-District Transfer on wedlock bases is one of them.
The constitution strongly safeguards the fundamental rights of citizens and employees as well. As a corollary to the gen position indicated in the preceding Para(s), some clauses of constitution are placed below to determine the fringe rights of citizens and to protect the rights of employees.
Article 14: Inviolability of dignity of man etc:( 1). Dignity of a man and, subject to law, the privacy of home, shall be inviolable.
Article 25: Equity of citizens:(1).All the citizen are equal before law and are entitled to equal protection of law.
(2). There shall be no discrimination on the basis of sex alone.
(3).Nothing in this Article shall prevent the State from making any special provision for the protection of women and children.
Article 38.Promotion of social and economic well-being of the people: The State shall:-
(a): Secure the well-being of the people, irrespective of sex, caste, creed or race, by raising their standard of living, preventing the concentration of wealth and means of production and distribution in the hands of few to the detriment of general interest and by ensuring equitable adjustment of rights between employers, and employees, and landlord and tenants.
(b): Provide for all citizens, within the available resources of the country, facility for work and adequate livelihood with reasonable rest and leisure.
© Provide for all persons employed in the service of Pakistan or otherwise, social security by compulsory social insurance or other means.
(d) Provide basic necessities of life, such as food, clothing, housing, education and medical relief for all citizens, irrespective of sex, caste, creed or race as are permanently or temporarily unable to earn their livelihood on account of infirmity, sickness or unemployment.
(e) Reduce disparity in the income and earning of individual, including persons in various classes of the service of Pakistan.
The managerial blocks as Tehsils, Districts and Division were made as per revenue oriented needs. The same were followed by the departments. In this format, the appointing authorities within department were territory based jurisdictions were given to them. The employee’s cadre
