Distracted Drivers; a National Dilemma

Abstract
Maine Public Law Chapter 446 Section 1. 29-A MRSA §2117 prohibits any activity that may distract a driver thereby impairing their ability to drive. Due to the overwhelming increase of cell phone use while driving in the past few years, Maine was one of many states to take action in an attempt to keep roads safer. Studies conducted proved using cell phones greatly increase the risk of being in an accident; also showed that distracted driver laws are beneficial. Idaho passed its own distracted driver law (Senate Bill 1352) March 10, 2010; however, it only addresses texting and driving, classifying it as inattentive driving. Political officials, insurance agencies, and the special interest group, Focus Driven all advocate for this kind of law. Based off of statistics and professional opinions, Idaho should adapt Senate Bill 1352 so that it is similar to Maine’s Distracted Driver Law, as it is a broader approach to the issue.

Policy Identification and Explanation
Texting and driving and talking on a cell phone both contribute to the same issue: the driver is distracted. Many states have taken action to ban cell phone use while driving. Maine has taken a unique, broad approach to the issue. Maine Public Law Chapter 446 Section 1. 29-A MRSA §2117 also known as “An Act to Establish a Distracted Driver Law” was formed in an effort to prohibit any activity that impairs a driver’s ability to drive. It includes “electronic devices, applying cosmetics, or performing personal grooming with any device” (Maine.gov, 2009). This law is unique to Maine as other states have simply tried banning cell phone use.
Policy History/Background
