Debate of the Second Amendment
The United States is the only one country that allows people to keep and bear arms. Because they have the second amendment, “A well regulated militia being necessary to the security of a free state, the right of people to keep and bear arms shall not be infringed.”(Bill of Right) But this law causes a lot of controversy, some people think keep and bear arms is the majority reason lead to rise of violent crime. Through good and evil repute, the second amendment is protect to people’ right, and this right is fundamental to the nation’s scheme of ordered liberty. (U.S. Constitution) There have two views to understand the second amendment.
The first view, the collective rights interpretation, argues that the Bill of Rights provides no protection for an individual right to own gun. (Cornell, 01.2001) The bills were written in particular time, Americans just end a war, and they need to unity, but the government was not very stability, they given the militia rights to keep and bear arms, in order to protect state, but there didn’t clearly define an individual right to own gun. With the rising crime rate, some people demanding tougher gun control laws. Especially in recent years, the campus shootings always happen, which increase suspicion of the people to own guns.
The second view, the second amendment not only gives the right to militia, but also gives right to individual. Charton Heston, whom president of NRA, has described the second amendment as America’s “First Freedom,” the foundation for all of the other tights contained in the Bill of Rights. (Cornell, 01.2011) In 2008, the Supreme Court had definitively held that the Second Amendment protects an individual’s tight to possess a firearm unconnected with service in a militia.(U.S. Constitution) The arms is regarded as a way of self-defense.
