The Citation to the case is 203 F.3d 135. The Key facts of the case are Danuta Ryduchowski worked for Port Authority as an engineer from 1988 to 1995. In September of 1995 Ms. Ryduchowski was fired from her job. On November 14th 1996 Ms. Ryduchowski filed a claim that Port Authority discriminated against her on the basis of her gender and national origin she claimed that, while working at the Port Authority, she was subjected to insults, jokes, and harassment related to her gender and national origin. She asserted that as a result of this discrimination, Port Authority failed to promote. They also did not pay her equally as they would a male colleague. Ms. Ryduchowskis was at time of hire the only female engineer on the staff. She had a good working relationship with Mr. Woods in the early nineties but Mr. Woods wanted a more personal relationship. She denied his advances and it was clear Mr. Woods was upset. He then harassed her for the next 4 years by making rude comments about her writing and national origin. Her supervisor than hired a male, Mr. Lopez and eventually got a better position and raise even though she was just as qualified, if not better for the position. Ms. Ryduchowski was not even asked to see if she wanted the higher position. The question the court had to decide was whether or not Port Authority discriminated against Ms. Ryduchowski based on Title IIV and if Port Authority followed legal regulation on the Equal Pay Act (EPA) on awarding people appropriate pay raises that were not discriminating and were of just cause. The court’s decision was That Port authority was guilty on the basis they could not show a valid merit system and the system that was already in place was flawed. They chose this way because there was sufficient evidence for the jury to conclude that gender-based discrimination affected Ryduchowski's performance evaluations and her merit increases.
