AUDIO RIGHTS INFRINGEMENT (Guidelines)
The purpose of these Guidelines is to assist in identifying infringements of the exclusive audio rights arising from and granted by the International Cricket Council (ICC) to IMG (and its various licensees), BIG FM and AIR in connection with the ICC Cricket World Cup 2011 (ICC CWC 2011). Copyright Integrity International (CII), one of the world’s leading online monitoring agencies, has been engaged by the ICC to protect rights and issue notices against infringers. These Guidelines provide a brief overview of the key elements of infringement of these exclusive audio rights and outline how the infringement notice scheme is intended to operate. A checklist is provided to offer guidance on the appropriateness of reporting a possible infringement for investigation and follow up. A simple sheet where the details of infringement may be reported to CII for action is also provided.

When are exclusive rights infringed?
The ICC has granted rights holders certain exclusive rights in relation to the ICC CWC 2011. These rights may be infringed through certain unlicensed and unauthorised uses of certain content, trade marks and designations. Infringement can occur whether or not the infringing work is used for profit. However, it is important to note that not all use of ICC CWC 2011 materials without license or authorisation constitutes infringement. Certain materials may be in the public domain and available for use, others may have limited protection and some uses may be considered fair use under local laws. Therefore, it is critical to put the potential infringement in its full context and to have available as much information as possible before deciding on the appropriateness and nature of legal action required.
