2 MAIN CONTRACT
The Employer shall make the Main Contract (other than the details of the Employer’s prices thereunder as stated in the bills of quantities or schedule of rates and prices as the case may be) available for inspection to the Contractor with and, if so requested by the Contractor, shall provide the Contractor with a certified true copy of the Main Contract (less such details of the Employer’s price), at the cost of the Contractor. The Contractor shall be deemed to have examined the Main Contract or a copy thereof and to have full knowledge of all the provisions of the Main Contract except the details of the price included therein.
2A. CONTRACT DOCUMENTS
a) Unless otherwise stated, the language in which Contract Documents shall be drawn up shall be the same as the language in which the Main Contract Documents have been drawn up.
b) The laws of Malaysia, for the time being in force in Malaysia, shall apply to the Contract and be the law according to which the Contract shall be construed and the Malaysian courts shall have exclusive jurisdiction to hear and determine all actions and proceedings arising out of this Contract and the Contractor hereby submits to the jurisdiction of the Malaysian courts for the purposes of any such actions and proceedings.
c) The original Contract Documents shall be prepared by and remain in the custody of the Employer and shall be produced as and when required by the Contractor. Immediately upon the execution of this Contract, the Employer shall furnish without charge to the Contractor one certified true copy of the Contract Documents.
d) The several documents forming the Contract are to be taken as mutually explanatory of one another but in the event of any conflict Of inconsistency between the documents forming the Contract, the priority shall be as follows:
i. The Articles of Agreement; ii. The Letter of Acceptance; iii. The Conditions of Contract and the Appendix (Part I & II); iv. Addendum to
