    “European law is based on two fundamental legal doctrines, direct effect and supremacy.”1 The doctrine of supremacy, which has no formal basis in the original Treaty of European Community,2 was first established by the European Court of Justice in the case of Flaminio Costa v ENEL3. The ECJ concluded in Costa that when conflicts arise, EU law always prevails over national law. Moreover, the ECJ argued that “the precedence of Community law is confirmed by Article 189, whereby a regulation ‘shall be binding’ and ‘directly applicable in all Member States’.”4 In other words, this doctrine of supremacy states that “in case, and to the extent, of irreconcilable results in the application of both legal systems to the same situation, the conflicting national law of member states becomes inapplicable.”5 Therefore, throughout this essay, I shall go on to examine the supremacy of EU Law over national law where this dialogue will be observed from the Court of Justice of the European Union’s (CJEU) perspective and from the national perspective of some of the Member States of the EU, taking into account the tension present between the two perspectives.…

It is laid down in treaties, conventions, regulations and declarations (verdragen, conventies, regelgeving, verklaringen). International law: 1.International public law is concerned with issues as the set-up of international institutions (united nations, European community, European court of human rights), human rights (European convention on human rights) and the extradition of nationals from another country to their home country. 2.International private law to solve problems in international legal relationships which arise from different legal systems. Every country has its own international private law. It deals with 3 main issues: 1. Jurisdiction in cases of litigation between 2 parties from different states (what court of law has jurisdiction?-EEX). 2. Solutions to legal problems arising out of an international legal relationship (Is there a specific treaty that provides an immediate solution?-CISG). European Community law(EC) the EC treaty and all legislation which is based on it, binding for all Member States of the EC. EC law deals with several aspects of international private law. International business law is a part of international private law.     It is something seen but not seen; real but not fully real as a presence; mysterious, hard to pin down, and certainly hard to view clearly and as a whole. Much research is now being done on transnational regulatory processes, institutions and aspirations, but it is difficult to see how these research developments affect outlooks in sociology of law in general[G. The theoretical implications of legal transnationalism unsettle the basis of Law and society' research and challenge its most basic concepts. Specifically, the meaning of both Law' and 'society' in the socio-legal field needs to be re-examined radically in the face of legal transnationalism. The emerging new pluralistic world of law, created by legal transnationalism, is one in which legal regimes with overlapping or unclear jurisdictions have indefinite relations with each other; and legal authority is relative and frequently disputed.
